2020 06 16 FCPEMSD MinutesMINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT June 16, 2020 The Board of Directors of the Baytown Fire Control, Prevention, and Emergency Medical Services District (FCPEMS) met in a Regular Meeting on Tuesday, June 16, 2020, at 4:30 P.M.; in the Baytown Conference Room of the Baytown City Hall, 2401 Market Street, Baytown, TX with the following attendance: Brenda Bradley Smith John Adkins Maurice Watts Richard Carr Rick Davis Trevor Fanning Leticia Brysch President Vice -President (Teleconference) Director Director General Manager Assistant General Counsel Secretary President Bradley Smith convened the June 16, 2020, FCPEMSD Board Regular Meeting with a quorum present at 4:30 P.M., all members were present with the exception of Directors Baldwin and Hawkins who were absent. 1. MINUTES a. Consider approving the minutes of the Baytown Fire Control, Prevention, and Emergency Medical District Special Meeting held on May 19, 2020. A motion was made by Director Maurice Watts, and seconded by Director Richard Carr made a motion to approve the minutes of the Baytown Fire Control, Prevention and EMS District meeting held on May 19, 2020, as submitted. The vote was as follows: Ayes: President Brenda Bradley Smith, Vice President John Adkins, Director Maurice Watts, Director Richard Carr Nays: None Other: Director Gerald Baldwin (Absent), Director Barry L Hawkins (Absent) Approved 2. FCPEMSD FISCAL YEAR 2020-21 PROPOSED BUDGET FCPEMSD Regular Meeting Minutes June 16, 2020 Page 2 of 6 a. Conduct a public hearing regarding the Baytown Fire Control, Prevention, and Emergency Medical Services District's Fiscal Year 2020-21 Proposed Budget. At 4:31 P.M., President Bradley Smith opened the public hearing regarding the Baytown Fire Control, Prevention, and Emergency Medical Services District's Fiscal Year 2020-21 Proposed Budget. Assistant General Manager Kevin Troller presented the item and stated that there were no changes in the budget or the action plan from the last meeting. He noted that the budget was directly associated to the tenants for the action plan which include (i) the Fire Training Facility, (ii) Fire and EMS personnel and (iii) apparatus such as a fire engine and/or ambulance. Mr. Troller further noted the budget shows personnel services in the amount of $402,841; $17,500 for supplies, cleaning and janitorial services; $22,500 for building maintenance; $60,200 related to the election and bonding requirements for the board members; and $245,000 for capital outlay for the purchase of an ambulance. Mr. Troller stated that there are two different transfers out of the budget; the first is in the amount of $851,300, that is the principal and interest payments for 2018 CO Bonds and the second is a one-time transfer of $300,000, to the City's General Fund which was needed during COVID-19 in case the District was unable to do the payback for the change orders, so this is just a payback to the General Fund, which results in a total transfers of $1,151,300. This leaves $2,062,196, in the budget with $162,854, in contingencies in case something was to happen during the year. At 4:35 P.M. President Bradley Smith closed the public hearing regarding Baytown Fire Control, Prevention, and Emergency Medical Services District's Fiscal Year 2020-21 Proposed Budget. b. Consider a resolution adopting the Baytown Fire Control, Prevention, and Emergency Medical Services District's Fiscal Year 2020-21 Proposed Budget. A motion was made by Director Maurice Watts, and seconded by Director Richard Carr made a motion to approve Resolution No. 72, related to Item 2.b. The vote was as follows: Ayes: President Brenda Bradley Smith, Vice President John Adkins, Director Maurice Watts, Director Richard Carr Nays: None Other: Director Gerald Baldwin (Absent), Director Barry L Hawkins (Absent) Approved RESOLUTION NO. 72 FCPEMSD Regular Meeting Minutes June 16, 2020 Page 3 of 6 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING OCTOBER 1, 2020, AND ENDING SEPTEMBER 30, 2021, IN ACCORDANCE WITH CHAPTER 344 OF THE TEXAS LOCAL GOVERNMENT CODE AND THE ALTERNATIVE PROCEDURES ADOPTED BY THE DISTRICT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 3. BAYTOWN FIRE CONTROL, PREVENTION, AND EMS DISTRICT CONTINUATION ELECTION a. Consider a resolution calling for a Continuation Election for the Baytown Fire Control, Prevention, and Emergency Medical Services District to be held on Tuesday, November 3, 2020. b. Consider a resolution authorizing the General Manager to negotiate and execute a Joint Election Agreement with Harris County, Texas, for the Baytown Fire Control, Prevention and Emergency Medical Services District's Continuation Election to be held on November 3, 2020. C. Consider a resolution authorizing the General Manager to negotiate and execute a Joint Election Agreement with Chambers County, Texas, for the Baytown Fire Control, Prevention and EMS District's Continuation Election to be held on November 3, 2020. President Bradley Smith allowed for the consideration items 3.a, 3.b, and 3.c to be considered together. Board Secretary Leticia Brysch addressed all three items together and noted that item 3.a., calls for the District's continuation election to re -authorize the District and its associated sales tax for another five years. She noted that the City was able to get the District's changed in the last legislative session to allow for the election cycle to reach its fifth year, which will be November 3, 2020. Mrs. Brysch noted that since the election is held in November, the District is required under state law to hold joint elections with the counties, which for Baytown are two: Harris County and Chambers County. Therefore, items 3.b. and 3.c., allow for the general manager with the support of its legal counsel to negotiate joint election agreements with Harris and Chambers County. Mrs. Brysch noted that as it relates to the budget, the election cycle straddles two fiscal year budgets and as such, a portion of the election costs will be paid out of this year's budget and the remaining portion will be paid out of next year's budget. As a final note, Mrs. Brysch noted that while the counties will handle the bulk of election, the staff will support the elections administration and handle those duties which cannot be contracted out to the counties. RESOLUTION NO. 75 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT AUTHORIZING THE GENERAL MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A JOINT ELECTION AGREEMENT WITH CHAMBERS COUNTY FOR THE CONTINUATION ELECTION TO BE HELD ON THE 3RD DAY OF NOVEMBER, 2020; AUTHORIZING FCPEMSD Regular Meeting Minutes June 16, 2020 Page 5 of 6 PAYMENT THEREFOR IN AN AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND AND NO/100 DOLLARS ($25,000.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4. PROPOSED RESOLUTION a. Consider a resolution canceling the Baytown Fire Control, Prevention and EMS District Regular Meeting Scheduled for Tuesday, July 21, 2020. Assistant General Manager Kevin Troller presented the item and noted that the District's last regular meeting was in April. He further noted that because the budgetary timeline was move up this year and all of the budget and election business is completed, there are no items for the District's regularly scheduled meeting for July 21, 2020. This item cancels said meeting and if needed, Board Secretary Brysch will poll the board for a special meeting upon request. A motion was made by Director Richard Carr, and seconded by Director Maurice Watts made a motion to approve Resolution No. 76, related to Item 4.a. Watts, Director Richard Carr Nays: None Other: Director Gerald Baldwin (Absent), Director Barry L Hawkins (Absent) Approved RESOLUTION NO. 76 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION AND EMERGENCY MEDICAL SERVICES DISTRICT CANCELING THE REGULAR BAYTOWN FIRE CONTROL, PREVENTION AND EMERGENCY MEDICAL SERVICES DISTRICT MEETING TO BE HELD ON JULY 211) 2020; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 5. REPORTS a. Present an update regarding the Baytown Fire Training Field. Assistant Fire Chief Aaron Smith presented the item and stated that the Fire Training Field's construction is going fantastically well and is moving right along. He noted that the Fire Department had received the an 18-wheeler and trailer as a donation from a local industry partner and are in the process of working with other local industry partners to acquire a rail car. Chief Smith also noted that Change Order No. 2 was passed, which includes a pond for water FCPEMSD Regular Meeting Minutes June 16, 2020 Page 6 of 6 reclamation which will allow for all of the water to be drawn out of the pond instead of the City's water system. 6. MANAGER'S REPORT a. The Next Baytown Fire Control, Prevention, and Emergency Medical Service District meeting is scheduled for Tuesday, October 20, 2020, at 4:30 P.M. in the Baytown Conference Room located at City Hall, 2401 Market Street, Baytown, Texas. Assistant General Manager Kevin Troller presented the item and thanked the quorum for their hard work and dedication. 7.
