AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ADOPTING THE RATE AND TAX LEVY FOR GENERAL FUND MAINTENANCE
AND OPERATION AND DEBT SERVICE FOR THE CITY OF BAYTOWN FOR
THE FISCAL YEAR ENDING SEPTEMBER 30,2014,UPON ALL TAXABLE
PROPERTY IN SAID CITY OF BAYTOWN IN ACCORDANCE WITH THE LAWS
OF THE STATE OF TEXAS AND THE CHARTER PROVISIONS AND
ORDINANCES OF SAID CITY;PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.

WHEREAS,the City's taxrate consists of the following two components:
1.theratethat,ifappliedtothetotaltaxablevalue,willimposetheamount of taxesneeded
topay debt service;and
2.theratethat,ifappliedtothetotaltaxablevalue,willimposetheamount of taxesneeded
tofund maintenance and operation expenditures of the City forthenextyear;and
WHEREAS,theproposedtaxrate of $0.43713per$100valuationformaintenanceand
operations togetherwiththeproposedtaxrate of $0.38490per$100valuationfordebtserviceexceeds
the effective tax rate;and
WHEREAS,theCityhavingposted,publishedandheldtherequisitepublichearingsin
accordancewithChapter26 of theTexasTaxCode,desirestoadoptthetaxrateformaintenanceand
operationsandthetaxratefordebtserviceforthe fiscal yearendingSeptember30,2014;NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:That the facts and matters setforthin the recitals of this Ordinance are hereby
found to be true and correct.
Section2:ThattheCityCouncil of theCity of Baytownherebyadoptsandsetsforthe
fiscalyearendingSeptember30,2014,anadvaloremtaxrate of $0.43713 foreachONEHUNDRED
AND NO/100 DOLLARS ($100.00)of assessed value of property locatedwithinthecitylimits of the
City of BaytownonJanuary1,2013,madetaxablebylaw,whichsaidtaxes,whencollected,shallbe
apportionedamongfundsanddepartments of CityGovernment of theCity of Baytownforthepurpose of
General Fund Maintenance and Operation.
Section3:Thattheadvaloremtaxrate of $0.43713,assetforthinSection2,ishereby
leviedandshallbe assessed and collected ononehundred percent (100%)of eachONE HUNDRED
AND NO/100 DOLLARS ($100.00)worth of property locatedwithinthecitylimits of theCity of
Baytown on January 1,2013,as valued bytheHarris County Appraisal District orthe Chambers County
Appraisal District andmade taxable bylaw.
Section 4:ThattheCity Council of theCity of Baytown hereby adopts andsetsforthe
fiscal year ending September 30,2014,anad valorem taxrate of $0.38490 for each ONE HUNDRED
AND NO/100 DOLLARS ($100.00)of assessed value of property locatedwithinthecitylimits of the
City of Baytown on January 1,2013,made taxable bylaw,which said taxes,when collected,shallbe
apportioned among funds and departments of City Government of the City of Baylown for the purpose of
Debt Service.
Section5:Thattheadvaloremtaxrate of S0.38490,assetforthinSection4.ishereby
leviedandshallbe assessed and collected ononehundredpercent (100%)of eachONE HUNDRED
AND NO/100 DOLLARS(S100.00)worth of propertylocatedwithinthecitylimits of theCity of
BaytownonJanuary1,2013,asvaluedbytheHarrisCountyAppraisalDistrictortheChambers County
AppraisalDistrictandmadetaxableby law.
Section6:ThattheTax Assessor and Collector of theCity of Baytown isherebydirectedto
assess,extendandenterupontheTaxRolls of theCityofBaytown,Texas,forthecurrentyearthe
amountsandrateshereinlevied,andtokeepacurrentaccountofsame.Allcollection of suchtaxes,as
wellascollection of taxesowedforprioryears,toincludepenaltyandinterestthereof,shallbedeposited
intheofficial depository oftheCityof Baytown tobe distributed between the General Fund andtheDebt
Service ona basis determined bythe percentage thateachbeartothetotaltaxrate.
Section7:Allordinancesorparts of ordinancesinconsistentwiththeterms of this
ordinance arc hereby repealed:provided however,that such repeal shallbeonlytotheextentofsuch
inconsistencyandinallotherrespectsthisordinanceshallbecumulative of otherordinancesregulating
and governing thesubjectmattercoveredbythis ordinance.
Section8:Ifanyprovisions,section,exception,subsection,paragraph,sentence,clauseor
phrase of this ordinance orthe application of same toany person orsetof circumstances,shall for any
reasonbeheldunconstitutional,voidorinvalid,suchinvalidityshallnotaffectthevalidity of the
remaining provisions ofthisordinanceortheir application to other personsorsetsof circumstances andto
thisendallprovisions of thisordinancearedeclaredto be severable.
Section9:This ordinance shalltakeeffect immediately fromandafteritspassagebythe
CityCouncil of theCity of Baytown.
