2021 01 04 CC Minutes, EmergencyMINUTES OF THE EMERGENCY MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 4, 2021 The City Council of the City of Baytown, Texas, met in an Emergency Meeting on Monday, January 4, 2021, at 5:01 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Laura Alvarado Council Member Chris Presley Council Member Charles Johnson Council Member Heather Betancourth Mayor Pro Tem (Teleconference) Jacob Powell Council Member David Himsel Council Member Brandon Capetillo Mayor (Teleconference) Rick Davis City Manager Karen Horner City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Ar ns Mayor Capetillo convened the January 4, 2021, City Council Emergency Meeting with a quorum present at 5:01 P.M., all members were present with the exception of Council Members Charles Johnson and David Himsel who were absent. Due to the COVID 19 Disaster and the CDC's recommendation regarding social distancing measures there was limited amount of space when maintaining the required 6-feet separation from others. However, the meeting allowed for two-way communications for members of the public who were not allowed to be physically present at this meeting. 1. PROPOSED ORDINANCES a. Consider an ordinance approving Change Oder No. 1 to the first renewal 2018 Annual Sewer Rehabilitation Project with Texas Pride Utilities, LLC. Director of Public Works and Engineering Frank Simoneaux presented the item and apologized for having to call a meeting on a short notice, but the city has a water leak that requires immediate attention in the form of a change order to complete the work. Mr. Simoneaux showed a map of the location of the leak, at the intersection of Thompson Road and I-10 Service Road, Westbound and on the outside lanes. He also showed a picture of where some of the water is accumulating and it is impeding traffic flow on the outside lanes of Thompson Road, as well as, on the service road turn lane. Mr. Simoneaux noted that the proposed ordinance approves a change order number one to the first renewal of the 2018 Annual City Council Emergency Meeting Minutes January 4, 2021 Page 2 of 3 Sewer Rehab contract with Texas Pride Utilities in the amount of one hundred eighty-seven thousand four hundred dollars. Mr. Simoneaux provided a brief history of the issue at hand. He stated that the Public Works and Engineering staff noticed a water leak in this area about a week ago; but at that time, the issue was not as bad. However, the situation has gotten increasingly worse, so much so, that the staff feels that they need to take immediate action on it to remedy the situation. Mr. Simoneaux noted that the leak in question may be from one of three water lines that are in this intersection; a 36-inch diameter main that is coming out of BAWA, a 12-inch waterline, and a 10-inch water line, both of which are owned by the City of Baytown. If the leak is determined to be on the 36-inch power line, then staff will do an interlocal agreement with the Baytown Area Water Authority (BAWA) to cover the costs of the repairs. Mr. Simoneaux further indicated that the proposed work includes the installation of traffic control to secure the work zone, the removal of the existing pavement, and the excavation of the water lines until the leak is identified. Tile repairs will include isolation of the leak and replacing the section of the water line that is damaged. Then, they will do restoration work that will include backfilling the trenches, restoring the subgrade of the roadway, and replacing the pavement per TxDOT standards. This change order increases the funding by twenty-five percent to the city's on -call contract with Texas Pride Utilities. Staff anticipates that Public Works and Engineering will self -perform some of the work, however, staff believes that it will be best to have Texas Pride as a partner in the process since they possess more specialized equipment that will be required in the excavation and personnel that may be required in repairing the leaks. Council Member Heather Betancourth asked Mr. Simoneaux how long they anticipate the repairs to take and he answered it will take at least a week, especially since the restoration will probably be significant. If the break is on the 36-inch line, they are going to have to call in another contractor since there is only one contractor authorized or specialized to work on the 36-inch line since it is a specialized pipe, which may delay the repair. Mayor Capetillo wanted to make confirm if the amount of one hundred eighty-seven thousand four hundred dollars would be suffice for any unforeseen repairs and Mr. Simoneaux stated that it was the maximum amount allowed by law to do a change order. Staff spoke to the sewer contractor, who is qualified to do the work, and the price they are estimating is actually less than a hundred thousand dollars so they are confident in moving forward with this amount and Public Works and Engineering will be self -performing some of the work in order to make the cost more palatable. A motion was made by Council Member Laura Alvarado, and seconded by Council Member Jacob Powell to approve Ordinance No. 14,640, related to item La. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Chris Presley, Mayor Pro Tem Heather Betancourth, Council Member Jacob Powell City Council Emergency Meeting Minutes January 4,2021 Page 3 of 3 Nays: None Other: Council Member Charles Johnson (Absent) and Council Member David Himsel (Absent) Approved ORDINANCE NO. 14,640 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING CHANGE ORDER NO. 1 TO THE FIRST RENEWAL OF THE 2018 ANNUAL SANITARY SEWER REHABILITATION PROJECT WITH TEXAS PRIDE UTILITIES, LLC, FOR EMERGENCY REPAIRS IN AN AMOUNT NOT TO EXCEED ONE HUNDRED EIGHTY- SEVEN THOUSAND FOUR HUNDRED AND NO!100 DOLLARS (S 187,400.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 2.
