2020 12 21 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN December 21, 2020 The City Council of the City of Baytown, Texas, met in a Special Meeting on Monday, December 21, 2020, at 5:03 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Laura Alvarado Chris Presley Robert Hoskins David Hiimsel Brandon Capetillo Rick Davis Karen Horner Leticia Brysch Keith Dougherty Council Member Council Member Council Member Council Member Mayor City Manager City Attorney City Clerk Sergeant at Arms Mayor Capetillo convened the December 21, 2020, City Council Special Meeting with a quorum present at 5:03 P.M., all members were present with the exception of Mayor Pro Tern Johnson and Council Member Betancourth, who were absent. The Invocation was led by City Manager Rick Davis and the Pledge of Allegiance and Texas Pledge was led by Mayor Brandon Capetillo. 1. ELECTION CANVASS a. Canvass the returns of the City of Baytown's December 12, 2020, Runoff Election. City Clerk, Leticia Brysch presented the tabulation results to Council froth the December 12, 2020, runoff election for Districts 5 and 6. Consider a resolution declaring the results of the City of Baytown Runoff Election held on Saturday, December 12, 2020. A motion was made by Council Member Robert C. Hoskins and seconded by Council Member David Himsel, approving Resolution No. 2,692 regarding agenda item l.b. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Chris Presley, Council Member Robert C. Hoskins, and Council Member David Himsel Nays: None Other: Mayor Pro Tent Charles Johnson (Absent) and Council Member Heather Betancourth (Absent) Approved RESOLUTION NO. 2,692 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CANVASSING THE RETURNS OF THE RUNOFF ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 12TH DAY OF DECEMBER, 2020, FOR THE PURPOSE OF ELECTING COUNCIL MEMBERS FOR COUNCIL DISTRICT NOS. FIVE (5) AND SIX (6) OF THE CITY OF BAYTOWN; FINDING THAT THE RUNOFF ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. City Council Special Meeting Minutes December 21, 2020 Page 5 of 9 2. REINVESTMENT ZONE NUMBER ONE, CITY OF BAYTOWN, TEXAS a. Conduct a public hearing regarding a proposed amendment of the approved project plan and reinvestment zone financing plan for Tax Increment Reinvestment Zone Number One, City of Baytown, Texas, resulting in an increase in a certain geographic area and project costs of the Zone and resulting in the decrease in a certain geographic area of the Zone. At 5:16 P.M., Mayor Capetillo opened and conducted the second public hearing public hearing regarding a proposed amendment of the approved project plan and reinvestment zone financing plan for Tax Increment Reinvestment Zone Number One, City of Baytown, Texas, resulting in an increase in a certain geographic area and project costs of the Zone and resulting in the decrease in a certain geographic area of the Zone. Assistant City Manager Nick Woolery presented the item and stated that this item includes an amendment that adds two projects, which are (1) the widening of John Martin Road and widening of Cedar Bayou Lynchburg Road, to serve the growth needs and economic development interests in the area. He further noted that the proposed amendment also adds land into the Zone's boundaries; including a combination of land inside City limits and outside City limits in unincorporated Harris County. The amendment also removes land owned by Chevron Phillips as the increment from this land has fully paid the costs of the associated project, the widening of Sjolander Road. Mr. Woolery noted that this item was approved by the TIRZ at their December 16"' meeting. With there being no one registered to speak regarding agenda item 2.a., Mayor Capetillo closed the public hearing at 5:18 P.M. b. Consider an ordinance annexing approximately 841.922 acres of land into Reinvestment Zone Number One, City of Baytown, Texas (the "Zone"); disannexing approximately 58.693 acres from the Zone; and adopting the Restated and Seventh Amended Project Plan and Reinvestment Zone Financing Plan. Assistant City Manager Nick Woolery presented the item and noted that the only other comment he had on this item is to clarify that area that is annexed into the TIRZ does not mean that it is being annexed into the City of Baytown, as they have separate boundaries. A motion was made by Council Member Robert C. Hoskins and seconded by Council Member Chris Presley, approving Ordinance No. 14,637, regarding agenda item 2.b. Hoskins, and Council Member David Himsel Nays: None City Council Special Meeting Minutes December 21, 2020 Page 6 of 9 Other: Mayor Pro Tern Charles Johnson (Absent) and Council Member Heather Betancourth (Absent) Approved ORDINANCE NO. 141637 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CHANGING THE BOUNDARIES OF REINVESTMENT ZONE NUMBER ONE, CITY OF BAYTOWN, TEXAS; APPROVING THE RESTATED AND SEVENTH AMENDMENT TO THE PROJECT PLAN AND REINVESTMENT ZONE FINANCING PLAN FOR REINVESTMENT ZONE NUMBER ONE, CITY OF BAYTOWN, TEXAS; AUTHORIZING THE CITY CLERK TO DISTRIBUTE SUCH PLANS; CONTAINING FINDINGS AND PROVISIONS RELATED TO THE FOREGOING SUBJECTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 3. STRATEGIC PARTNERSHIP AGREEMENT FOR CHAMBERS COUNTY MUD NO.3 a. Consider an ordinance authorizing a Strategic Partnership Agreement with Chambers County Municipal Utility District No. 3. b. Consider an ordinance authorizing a Water Supply Agreement with Chambers County Municipal Utility District No. 3. A motion was made by Council Member Robert C. Hoskins and seconded by Council Member David Himsel approving Ordinance No. 14,638, regarding agenda item 3.a., and Ordinance No. 1416391 regarding agenda item 3.b. ORDINANCE NO. 14,639 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A WATER SUPPLY AGREEMENT WITH CHAMBERS COUNTY MUNICIPAL UTILITY DISTRICT NO. 3; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 555 a. Consider an ordinance authorizing a Development Agreement with Forestar Group Inc., for property to be located in Harris County Municipal Utility District No. 555. A motion was made by Council Member Robert C. Hoskins and seconded by Council Member David Himsel suspending item 4.a. for a meeting no later than 120 days from the current meeting. Conduct the election of the Baytown City Council Mayor Pro Tem. A motion was made by Council Member Robert C. Hoskins and seconded by Council Member David Himsel to elect Council Member Heather Betancourth as the next Mayor Pro Tem to serve a 6-month term beginning on January 1, 2021. A motion was made by Council Member Robert C. Hoskins and seconded by Council Member David Himsel to approve item 5.b. as noted.
