AN ORDINANCE OF THE CITY COUNCIL OF T11E CITY OF BAYTOWN,
TEXAS, ACCEPTING THE PROPOSAL OF DUROTECH, INC., FOR THE
PUBLIC SAFETY FACILITY PROJECT; AUTHORIZING AND DIRECTING
THE CITY MANAGER AND CITY CLERK TO EXECUTE AND ATTEST TO
A CONSTRUCTION MANAGER -AT -RISK CONTRACT DUROTECH, INC.,
FOR THE PROJECT; AUTHORIZING PAYMENT NOT TO EXCEED THE
SUM OF EIGHTY-NINE THOUSAND AND NO/100 DOLLARS ($89,000.00)
FOR PRE -CONSTRUCTION SERVICES; MAKING OTHER PROVISIONS
RELATED THERETO; AND PROVIDING FOR TIIE EFFECTIVE DATE
THEREOF.

WHEREAS, on November 17, 2020, via Resolution No. 2686, the City Council
determined that the construction manager -at -risk method of construction was the alternate
delivery method that provided the best value to the City for construction services for the
Baytown Public Safety Facility; and
WHEREAS, pursuant to the construction manager -at -risk one-step process, the City
advertised for proposals to be received on December 17, 2020; and
WHEREAS, notice to proposers as to the time and place, when and where the bids would
be publicly opened and read aloud was published in a manner prescribed by law; and
WHEREAS, all proposals were opened and publicly read at the Baytown City Hall at
2:00 o'clock p.m., Thursday, December 17, 2020, as per published notice to proposers; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the proposal
of Durotech, Inc., for the Public Safety Facility Project and authorizes payment of an amount not
to exceed EIGHTY-NINE THOUSAND AND NO/100 DOLLARS ($89,000.00) for pre -
construction services. The City Manager and the City Clerk of the City are hereby authorized
and directed to execute and attest to a Construction Manager -at Risk Contract with Durotech,
Inc., for the above -described project, said contract containing appropriate bond requirements in
accordance with the provisions of Texas Government Code, Chapter 2253.
Section 2: That pursuant to the provisions of Texas Local Government Code
Annotated § 252.048, the City Manager is hereby granted general authority to approve any
change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/ 100
DOLLARS ($50,000.00) or less, subject to the provision that the original contract price may not
be increased by more than twenty-five percent (25%) or decreased by more than twenty-five
percent (25%) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
