Ordinance No. 14,611ORDINANCE NO. 14,611 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING AND RESTATING THE BOUNDARIES OF REINVESTMENT ZONE NO. ONE, CITY OF BAYTOWN, TEXAS; CONTAINING VARIOUS PROVISIONS RELATED TO THE FOREGOING SUBJECT; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** WHEREAS, the City Council of the City of Baytown passed Ordinance No. 9197 on August 9, 2001, which created Reinvestment Zone No. One, City of Baytown, Texas, (the "Zone") for the purposes described therein, and subsequently approved a Project Plan and Reinvestment Zone Financing Plan with respect to the Zone, as well as the annexation and exclusion of land into and out of the Zone; and WHEREAS, the City Council approved the Project Plan and Reinvestment Zone Financing Plan, as amended and restated and approved by Ordinance No. 13,423 dated March 9, 2017 (the "Restated Plan"), for the Zone; and WHEREAS, because of the multiple additions and exclusions relating to the Zone approved by the City Council over the life of the Zone and the possibility of confusion and error inherent therein, the Board of Directors of the Zone has requested, to better implement the Plan, that the City Council adopt an ordinance to approve and restate the boundaries of the Zone in one document; and WHEREAS, the City Council wishes to approve and restate the boundaries of the Zone as requested by the Zone Board, and as previously approved in connection with the Restated Plan in 2017; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, that: Section 1: The findings contained in the preamble to this ordinance are declared to be true and correct and are hereby adopted as part of this ordinance. Section 2: The land described in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes, is hereby declared to be the current boundary of the Zone, reflecting the creation of the Zone, as well as additions and exclusions of land by City Council from time to time. Such boundary is hereby ratified and declared to be a true and correct description of the current boundary of the Zone, each tract effective as of the date of the applicable ordinance effecting addition or exclusion of the land by City Council, or as of the adoption of the applicable Plan amendment contemplating the addition or exclusion of such land. Section 3: The appropriate City officials are authorized and directed to take all actions reasonably necessary to implement the terms of this ordinance. Section 4: If any provision, section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to any person or set of circumstances is for any reason held to be unconstitutional, void, or invalid, the validity of the remaining portions of this ordinance or their application to other persons or sets of circumstances shall not be affected thereby, it being the intent of the City Council in adopting this ordinance that no portion hereof or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, voidness, or invalidity of any other portion hereof, and all provisions of this ordinance are declared to be severable for that purpose. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
