AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, GRANTING AN EXTENSION OF TIME FOR THE COMPLETION
OF THE CONSTRUCTION OF THE INFRASTRUCTURE FOR SECTION 7
OF THE LEGENDS BAY SUBDIVISION AND FOR THE SUBMISSION OF
THE FINAL PLAT OF SECTION 7 OF THE LEGENDS BAY SUBDIVISION;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, on July 18, 2017, the Planning and Zoning Commission of the City of
Baytown approved the Legends Bay Subdivision Section 7 Preliminary Plat (the "Subdivision");
and
WHEREAS, the preliminary plat of such subdivision expired on July 17, 2020, which is
1,095 days after its approval by the Planning and Zoning Commission of the City of Baytown;
and
WHEREAS, on December 2, 2020, the developer appealed in writing to the City Council
for additional time to complete the Subdivision's infrastructure and to file the final plat for the
Subdivision; and
WHEREAS, Section 126-186(d) of the Code of Ordinances (the "Code") allows the City
Council to grant additional time not to exceed 360 days if the City Council finds that the
requested extension of time is not caused, directly or indirectly,
1. by any action or omission of the developer, his engineer, or their respective officers,
agents or employees or
2. by the diligent pursuit thereof by any such person; and
WHEREAS, after considering the developer's appeal and the reasons therefor, the City
Council finds that the requested extension of time satisfies the requirements of Section 126-
186(d) of the Code and should be granted; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That all matters and facts set forth in the recitals hereinabove are found to
be true and such recitals are hereby approved and made a part of this ordinance for all purposes
and are adopted as a part of the judgment and findings by the City Council of the City of
Baytown, Texas.
Section 2: That the City Council of the City of Baytown hereby grants a 360-day
extension of time for the completion of the construction of the Subdivision's infrastructure and
for the submission of the final plat of the Subdivision.
Section 3: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
