2020 09 24 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN September 24, 2020 The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, September 24, 2020, at 6:33 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Laura Alvarado Council Member Chris Presley Council Member Charles Johnson Mayor Pro Tem Heather Betancourth Council Member Robert Hoskins Council Member David Himsel Council Member Brandon Capetillo Mayor Rick Davis City Manager Karen Horner Assistant City Attorney Leticia Brysch City Clerk Keith Dougherty Sergeant at Arms Mayor Capetillo convened the September 24, 2020, City Council Regular Meeting with a quorum present at 6:33 P.M., all members were present. Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Heather Betancourth. Due to the COVID 19 Disaster and the CDC's recommendation regarding social distancing measures there was limited amount of space when maintaining the required 6-feet separation from others. However, the meeting allowed for two-way communications for members of the public who were not allowed to be physically present at this meeting. 1. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Recognize City of Baytown Employees for their Years of Service. Human Resources Director Carol Flynt presented the item and provided a video presentation for all the individuals that received years of service awards for the month of September. PROPOSED ORDINANCES a. Consider an ordinance adopting the tax rate for General Fund Maintenance and Operations at $0.484 per $100 valuation for the fiscal year ending September 30, 2021, and adopting the tax rate for Debt Service at $0.31115 per $100 for the fiscal year ending September 30, 2021. Finance Director Victor Brownlees presented the item and stated that at the last meeting they had received the final valuations from Harris County and also considered the no-new revenue tax rate and the voter-approval tax rate, and noted that they were both significantly higher than the current tax rate in the City. He had also promised at that meeting to consider it further in the context of the budget they had just set and their very clear policy direction to further lighten the load for the tax payers. Mr. Brownlees was very pleased to present a reduction to the current tax rate, which results in a total tax rate of $0.79515 per $100 valuation, which is a rate reduction of $0.00688. It would put the city at over 2.5 cents less than the voter approved rate and will be the lowest tax rate for the City of Baytown in the past 10 years. Mr. Brownlees stated that the staff recommended approval of the item. Mayor Capetillo commended staff on their due diligence and efforts and noted that this was the third tax reduction passed in the past three years, while continuing to focus on growth and reconstruction in the City. A motion was made by Council Member Robert C. Hoskins, and seconded by Council Member Heather Betancourth to approve Ordinance No. 14,506, related to Item 2.a. Hoskins and Council Member David Himsel Nays: None Approved City Council Regular Meeting Minutes September 24, 2020 Page 3 of 14 ORDINANCE NO. 14,506 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ADOPTING THE RATE AND TAX LEVY FOR GENERAL FUND MAINTENANCE AND OPERATIONS AND DEBT SERVICE FOR THE CITY OF BAYTOWN FOR THE FISCAL, YEAR ENDING SEPTEMBER 30, 2021, UPON ALL TAXABLE PROPERTY IN SAID CITY OF BAYTOWN IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS AND THE CHARTER PROVISIONS AND ORDINANCES OF SAID CITY; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Consider an ordinance awarding a construction contract to Construction Masters of Houston, Inc., for the Animal Services and Adoption Shelter Project. Assistant Director for Public Works and Engineering Andrea Brinkley presented the item and stated that this project was basically an alternative delivery project with a competitive sealed proposal program, which is offered as an option in the Texas Local Government Code. She noted that the selected bid was a best value consideration rather than the lowest price, which was determined based on the evaluation criteria noted in the bid documents. She noted that the staff had a total of eight (8) proposing contractors and the prices provided made it a very tightly packed proposal consideration. Three of the best scoring firms were interviewed and Construction Masters of Houston, Inc. received the highest evaluation score of 90.0 out of 100 points. The base bid (without alternates) for the Construction Masters of Houston, Inc. was $6,188,600.00 and because they had advantageous pricing, staff was able to negotiate with the contractor and incorporate important items into the project, such as shaded canopies. Staff also considered the pricing provided for concrete paving, lighting and drainage, and successfully negotiated a post bid amendment of an estimated $302,000 value, which will be held until end of construction. Mrs. Brinkley noted that the total contract cost for this project is in the amount of $6,532,983.73, and includes the base bid, alternate nos. 5, 6, 7 and the post bid amendment. She noted that the construction has a time frame of 494 days, and hope for a groundbreaking event on Friday, October 9th. PARK LAND DONATION a. Consider an ordinance accepting the donation of approximately 8.6 acres of land out of the W.G. Bayliss 50-acre tract in the William Scott Lower league, Abstract 65, Harris County, Texas, from the Dittman Family for park purposes. b. Consider a resolution naming the 8.6-acre park property dedicated by the Dittman Family as the Dittman Family Park. Parks and Recreation Director Scott Johnson summarized agenda items 3.a. and 3.b. together as they were associated. He stated this proposed ordinance accepts the donation of approximately 8.6 acres of land from the Dittman Family for park purposes. The property being conveyed is located along Kilgore Road and adjacent to approximately 10.95 acres previously donated to the city by David Rogers. The property is adjacent to Cedar Bayou and will provide an additional access to the bayou for the public. The acceptance of the deed not only designates the property as a public park but also obligates the city to name this park property after the Dittman Family, "Dittman Family Park" whose naming was approved by the Parks and Recreation Advisory Committee at its meeting on August 5, 2020. A motion was made by Council Member David Himsel, and seconded by Council Member Laura Alvarado to approve Ordinance No. 14,508, related to Item 3.a., and Resolution No. 2677, related to Item 3.b. Consider a resolution casting the City of Baytown’s ballot for the Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election. City Clerk Leticia Brysch presented the item and stated that the council members had received a red-lined copy of the proposed resolution with staff’s recommendation and if approved, the four individuals will need to be included in the motion to approve. Mayor Capetillo read aloud the four individuals’ names for the record, and they are Robert Herrera, John Fullen, Jeffrey Snyder, and Robert Hauck, for the TML Intergovernmental Risk Pool Board of Trustees Election. A motion was made by Council Member Robert C. Hoskins, and seconded by Council Member Chris Presley to approve Resolution No. 2678, related to Item 4.a. APPOINTMENTS a. Consider confirmation of the City Manager's appointment of the City Attorney. City Manager Rick Davis confirmed his appointment of Mrs. Karen L.
