LICENSES FOR MICROSOFT OFFICE THROUGH THE TEXAS
DEPARTMEN't' OF INFORMATION RE-SOURCES; MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATETHEREOF,

WHEREIAS, the City of Baytown has entered into an interlocal cooperative contract witli
the Texas Department of" Information Resources ("DIR") for the purchase of three hundred
ninety (390) licenses for Microsoft Office Pursuant to Section 791.025 of the Texas Government
Code for the Police Department; and
WHEREAS, the DIR's purchasing process includes posting the request on the Electronic
State Business Daily (F"S111)), gathering and reviewing the vendors' responses to the posting,
negotiating with selected vendors, and managing vendor contracts; and

WHf, , REAS, such process in combination with the interlocal cooperative contract allows
the City to purchase automated information systems products and/or services in an efficient, cost
effective, and competitive procurement method; and
WFIE'RI"AS, the City of Baytown in making, a purchase under a DIR contract through its
interlocal cooperation contract satisfies state law requiring municipalities to seek competitive
bids for the purchase of the item; NOW Ti -II,
BE IT ORDAINED BY T[-IE CITY COUNCIL OF Tiir CITY OF BAYTOWN,
,rEXAS:
Section I: That the City Council of the City of Baytown hereby authorizes the
payment of ONE HUNDRED ONE THOUSAND FIFTY-SIX AND 80/100 I)OI.J1ARS
($101,056.80) to Dell Marketing L.P., for the purchase of three hundred ninety (390) licenses for
Microsoft Office through the Texas Department of Information ReSOUrces,
Section 2: That the City Manager is hereby granted general authority to approve any
change order involving a decrease or in increase in costs ot"FIFTY THOUSAND AND NO/] 00
DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased
by more than twenty-five percent (250/0) or decreased by more than twenty-five percent (25%)
without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown,
