Ordinance No. 12,307ORDINANCE NO. 12,307 AN ORDINANC]" OFTHE CITY COUNCIL OF THE crry OF BAYTOWN, TEXAS, RENEWING THE ANNUAL INSTALLATION AND REPAIR OF TRAFFIC SIGNAL EQUIPMENTCON'l-RACT WITH SOUTHWEST SIGNAL SUPPLY, INC.; AUTHORIZING PAYMENT BY T] IE CITY 01-BAYTOWN IN AN AMOUNT No'r TO EXCEED ONE HUNDRF"D THIRTY-THRIEE THOUSAND SIX HUNDRED AND NO/I 00 DOLLARS ($13 3,600.00); MAKING OTHER PROVISIONS REI.,ATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATETHEREOF. :* * * * * * * * * ** * * * * ** * * * * ** * * * * ** * ** * *** ** * *** * * * *** * * ** * * ** * * * * * *** ** **** * * * * 4, ** * * * WI-IF"REAS, Southwest Signal Supply, Inc., was awarded the Annual Installation and Repair of Traffic Signal Equipment Contract on August 23, 2007, pursuant to conipelitive bidding procedures, which contract included an option by the parties to renew for additional one-yea• periods: and WHEREAS, such contract was renewed on July 24, 2008, August 13, 2009, May 27, 2010, July 14, 2011, and August 23, 2012, and can be renewed for an additional one-year term; and WHEREAS, Southwest Signal Supply, Inc., has indicated its willingness to renew the contract for an additional year' under the same terms and conditions; and WITEREAS, the Administration has reviewed the market conditions and recommends renewal as being in the best interest of the City; NOWTI-IEREFORE BE I7' ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAY'"I'OWN, Tt,,',"XAS: Section 1: That the City Council of the City of Baytown hereby renews the Annual Installation and Repair of Traffic Signc 11 I Equipment Contract with Southwest Signal Supply, Inc., fol an additional one-year period. Section 2: That the City Council of the City of Baytown hereby authorizes payment in an amount not to exceed ONE FlIJNDRE' D THIRTY-THREE Tl JOU SAND SIX HUNDRED AND NO/100 DOLLARS ($133,600,00) to Southwest Signal Supply, Inc., 'or the Annual Installation and Repair ofTraffic Signal Equipment Contract. Section 3: That pursuant to the provisions ofTexas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/I 00 DOLLARS ($50,000.00) or less, subJect to the provision that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 4- This ordinance shall take effiect immediately from and after its passage by the City Council of the City of Baytown.
