RESOLUTION NO. 1103
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, SUPPORTING THE CITY OF LA PORTE IN ITS EFFORT TO
HAVE THE TEXAS WATER COMMISSION RECONSIDER AND WITHDRAW
ITS ACTION APPROVING THE APPLICATION OF HOUSTON CHEMICAL
SERVICES, INC.
WHEREAS, in 1986 Houston Chemical Services, Inc. applied to
the Texas Water Commission for a permit for a hazardous waste
incineration facility; and
WHEREAS, the City of La Porte , Harris County, and various
other entities have formally opposed such permit with over a
million dollars on technical studies and participation in the
hearings process; and
WHEREAS, the Texas Water Commission voted on September 11 ,
1990 , to issue the permit despite the Hearing Examiner ' s
recommended denial citing health and safety factors following a
sixteen (16) month hearing; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas , supports the City of La Porte, Harris County, and the
various other entities in their efforts to have the Texas Water
Commission reconsider and withdraw its action approving the
application of Houston Chemical Services , Inc . for a hazardous
waste incineration facility permit.
Section 2 : This resolution shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.

City Council of the City of Baytown , this the 23rd day of
