RESOLUTION NO. 1059
A RESOLUTION CANVASSING THE RETURNS OF THE MUNICIPAL
RUN-OFF ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE
3RD OF JUNE, 1989, FOR THE PURPOSE OF ELECTING A MAYOR
FROM THE CITY AT LARGE, ONE COUNCILMAN FROM DISTRICT
NO. 3, AND ONE COUNCILMAN FROM DISTRICT NO. 4;
DECLARING THE RESULTS OF SAID RUN-OFF ELECTION; FINDING
THAT NOTICE OF SAID RUN-OFF ELECTION WAS DULY AND
PROPERLY GIVEN AND THAT SAID RUN-OFF ELECTION WAS
PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE
PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE
STATE OF TEXAS.

WHEREAS, pursuant to Article IX, Section 96 of the Charter
of the City of Baytown, the City Council of said City, at a
regular meeting held on the 8th day of June, 1989, proceeded, as
required by law, to canvass the returns of the Municipal Run-off
Election held in the City of Baytown on the 3rd day of June,
1989, for the purpose of electing a Mayor from the City at large,
one Councilman from District No. 3 and one Councilman from
District No. 4; said Run-off Election having been held under and
pursuant to the provisions of the Charter of said City and an
ordinance duly passed on the 23rd day of May, 1989, calling a
Run-off Election; and
WHEREAS, said Run-off Election having been duly and
regularly had and held as called in said Ordinance and according
to law, and the returns thereof having been duly made and the
Run-off Election Judges having certified the results of said Run-
off Election, as hereinafter set out, and the City Council having
duly and regularly canvassed the returns of said Run-off Election
and finding that the total votes cast at said Run-off Election
were as follows , to-wit:
FOR MAYOR (FROM CITY AT LARGE)
Emmett 0. Hutto 2, 343 votes
A. Jean Shepherd 1,429 votes
FOR COUNCILMAN DISTRICT NO. 3
Bobby Credille 390 votes
Dorothy Tyrell Harrison 276 votes
FOR COUNCILMAN DISTRICT NO. 4
Jimmy Johnson 539 votes
Michael E. Turner 381 votes
AND WHEREAS, the City Council of the City of Baytown finds
the Run-off Election returns set out above to be accurate and
correct and no Run-off Election protest or contest having been

filed with said Council or instituted in connection with said
Run-off Election returns; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS :
Section 1: That Emmett 0. Hutto received a majority of the
votes cast at said Run-off Election for the office of Mayor at
large, and accordingly, the said Emmett 0. Hutto is hereby
declared elected to the office of Mayor at large for the City of
Baytown.
Section 2 : Bobby Credille received a majority of the votes
cast at said Run-off Election for the office of Councilman from
District No. 3, and accordingly, the said Bobby Credille is
hereby declared elected to the office of Councilman from District
No. 3.
Section 3 : That Jimmy Johnson received a majority of the
votes cast at said Run-off Election for the office of Councilman
from District No. 4, and accordingly, the said Jimmy Johnson is
hereby declared elected to the office of Councilman from District
No. 4.
Section 4 : That the City Council of the City of Baytown
further finds that the notice of said Run-off Election was duly
and properly given as required by law and as provided in the
Ordinance calling said Run-off Election and that said Run-off
Election was duly and regularly held and the returns thereof duly
and regularly made by the proper officials of said Run-off
Election and in all things according to law.
Section 5 : This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 8th day of June,
1989.
