RESOLUTION NO. 1044
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ENCOURAGING THE LEGISLATURE OF THE STATE OF TEXAS
TO ADOPT THE TEXAS SMOKE-FREE INDOOR AIR ACT; DIRECTING
THAT COPIES BE SENT TO APPROPRIATE LEGISLATORS; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, numerous citizens of the City of Baytown have
encouraged City Council to take action to prohibit smoking in
public places and at public meetings, citing the right of
citizens to be protected from secondary smoke; and
WHEREAS, the City Council of the City of Baytown desires to
protect the public health, comfort and the environment of the
City of Baytown by regulating smoking in public places and at
various public meetings; and
WHEREAS, there is presently pending before the Texas
Legislature House Bill No. 458, also known as the Texas Smoke-
Free Indoor Air Act, which will provide for statewide regulation
of smoking in public places and at public meetings of all types
as specified in the bill; and
WHEREAS, the City Council, having reviewed this proposed
legislation, believes that the adoption of this bill by the Texas
Legislature would best promote the health and comfort of citizens
by enacting such regulations on a statewide basis; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS :
Section 1 : That the City of Baytown hereby urges the Texas
Legislature to pass House Bill No. 458, also known as the Texas
Smoke-Free Air Act, so that there will be statewide regulations
prohibiting smoking in public places and at public meetings, as
such regulations will help promote the public health, comfort and
safety of the citizens of Baytown and the State of Texas by
protecting our citizens from unwanted secondary smoke.
Section 2 : The City Clerk is hereby authorized and directed
to send copies of this resolution to all the legislators
representing the Baytown area and to such other legislators the
administration deems appropriate.
Section 3 : This resolution shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
