RESOLUTION NO . 1003
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, OPPOSING THE PERMIT APPLICATION OF BIO WASTE
MANAGEMENT COMPANY, INC. CONCERNING A PROPOSED WASTE
DISPOSAL SITE; DIRECTING THE CITY CLERK TO SEND A
CERTIFIED COPY OF THIS RESOLUTION TO THE TEXAS
DEPARTMENT OF HEALTH; AND PROVIDING FOR THE EFFECTIVE
DATE HEREOF .
WHEREAS, Bio Waste Management Company, Inc. has submitted
Permit Application No. 1910 to the Texas Department of Health to
license a waste disposal site for the burning of certain wastes;
and
WHEREAS, this disposal site has been in operation prior to
the permit application, and citizens of the surrounding area have
complained of frequent noxious odors coming from the existing
facility; and
WHEREAS, the citizens in the area surrounding the proposed
site are dependent upon wells for their water supply, and the
City has serious concerns as to the affect the applicant' s septic
tank disposal system may have upon the underground water supply;
and
WHEREAS, the site proposed to be permitted is within an area
that is almost completely residential in use, and therefore may
have an adverse affect on both the property values in this area
and the quality of life currently enjoyed by the citizens in the
area; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS :
Section 1 : That the City Council hereby expresses to the
Texas Department of Health its opposition to the granting of
Permit Application No. 1910, which is the request of Bio Waste
Management Company, Inc. , to operate a solid waste disposal site
in the Baytown area.
Section 2 : That the City Clerk of the City of Baytown is
hereby authorized and directed to have certified copies of this
resolution delivered to the appropriate officials of the Texas
Department of Health.
Section 3 : This Resolution shall become effective from and
after its passage by the City Council of the City of Baytown.
