RESOLUTION NO. 983
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
APPROVING THE SETTLEMENT OF A TAX CLAIM AGAINST THE
GUSTAFSON GROUP; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, the City of Baytown filed a tax suit against the
Gustafson Group, Inc . and James W. Gustafson for delinquent
taxes, Cause Number 82-38798, in the 215th District Court, Harris
County, Texas; and
WHEREAS, the fact issue of this case concerns the
entitlement of the property owner to open-space evaluation for
the tax years 1981, 1982, and 1983; and
WHEREAS, the parties to this suit have agreed to a
settlement of this dispute, whereby the property owners will pay
$16, 246. 40 as the taxes due on the subject property for the years
1981, 1982, and 1983;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BAYTOWN, TEXAS :
Section 1: That the City of Baytown agrees to accept the
sum of SIXTEEN THOUSAND TWO HUNDRED FORTY-SIX AND 40/100
($16, 246. 40) DOLLARS from the Gustafson Group as full and
complete payment of all City of Baytown ad valorum taxes due on
City of Baytown tax account numbers 450-007-001-0 and
1242-000-070-0. No additional penalty or interest shall accrue
on this amount if it is paid prior to June 1, 1987.
Section 2 : This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown .
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 14th day of May,
1987.
