CC Resolution No. 9521708 RESOLUTION NO. 952 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN URGING THE LEGISLATORS FROM THE BAYTOWN AREA TO SUPPORT LEGISLATION MODIFYING THE EPA NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT REGULATIONS; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. �-*�.�-+w*�rw*s■x****■*.�cs�tr***�r,c■**s,c�-�-*a***.****�r*�,c�s*+z�-�t*,c,c* �x*�*,c-�*.*a*�,c** WHEREAS, the Environmental Protection Agency has published regulations concerning the national pollutant discharge elimination system permit program in the Federal Register dated September 26, 1984, and WHEREAS, the above described regulations require permits for many more water discharge sources than have been required in the past, including storm water point sources; and WHEREAS, these new regulations would require permit applications from governmental entities, commercial businesses, and industrial sites for any storm water discharge point, storm water run-off from parking lots, or storm water run-off from industrial sites; and WHEREAS, the proposed regulations do not differentiate between contaminated and non -contaminated storm water run-off; and WHEREAS, the definition of industrial storm water point sources includes areas such as access roads, and does not distinauish between areas that might have pollutants and areas that do not, and WHEREAS, areas such as parking lots can not be controlled through the permitting process due to the large number of users who contribute to any pollutants being on such parking lots, and WHEREAS, the EPA has proposed no practical treatment process for treating the storm water run-off from parking lots or other such sites, and WHEREAS, the number of point sources in the country is so enormous it is unlikely that the EPA will be able to develop a basis for issuing permits for such a disparate group of sources, and it is therefore doubtful that such permitting will be accomplished, making the whole permittinq process a pointless waste of time and h" the ncrmithocc .nH 1709 WHEREAS, the EPA has in the past made progressive efforts to control contaminated storm water run-off and made realistic decisions to exempt non - contaminated storm water point sources and to control non -contaminated point sources by other methods, but has been limited by federal court decisions which state that the EPA could not lawfully exempt these point sources, and WHEREAS, legislation is necessary to give the EPA the authority to enact realistic regulations for the control of storm water run-off; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That all of the legislators representing the Baytown area are asked, urged, and encouraged to support legislation that would amend Section 402 of the Clean Water Act to give the Environmental Protection Agency the ability to adopt realistic and workable regulations that would exempt various types of storm water run-off sources from its permitting process, thus saving the citizens, local businesses, and local governments literally millions of dollars in cost that would otherwise be expended. Section 2: That area legislators are urged to adopt such legislation in order to re-enact the original intent of the EPA regulations, rather than allowing the Courts to impose restrictions that were never intended. Section 3: This resolution shall take effect immediately from and after its passage.
