RESOLUTION NO. 911
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, URGING DEFEAT OF PROPOSED MOBILE HOME
LEGISLATION POSING A THREAT TO THE DOCTRINE OF SELF
DETERMINATION.

WHEREAS, the Citizens of Texas and the State Legislature in 1913 voted to
give the Citizens the right of self determination through the creation of home rule
cities; and
WHEREAS, cities around the State have exercised this authority in a judicious
and careful manner since being granted that authority; and
WHEREAS, cities have used this authority to respond to Citizens' concerns for
regulation of mobile homes for the health, safety and welfare of their community
through the passage of ordinances which establish mobile home placement
regulations; and
WHEREAS, it is in the best interest of the Citizens for their general health,
safety, welfare and protection property values, to restrict the location of mobile
homes; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the Texas Legislature is urged to defeat proposed mobile
home legislation as not being in the best interest of the Citizens of Texas because
of the threat if poses to the doctrine of local self determination and which in any
way would abolish or limit the power of any city in the State of Texas to restrict
the location of mobile homes.
Section 2: This resolution shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 11 th day of April, 1985.
