RESOLUTION NO. 910
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, URGING DEFEAT OF PROPOSED BILLBOARD
LEGISLATION POSING A THREAT TO THE DOCTRINE OF SELF
DETERMINATION.

WHEREAS, the Citizens of Texas and the State Legislature in 1913 voted to
give the Citizens the right of self determination through the creation of home rule
cities; and
WHEREAS, cities around the State have exercised this authority in a judicious
and careful manner since being granted that authority; and
WHEREAS, cities have used this authority to respond to Citizens concerns for
regulation of billboards for the health and safety of their community through the
passage of ordinances which establish billboard standards and require nonconforming
billboards to be removed after completion of an equitable amortization period; and
WHEREAS, the ability of cities to utilize amortization as a means of
billboard regulation has been upheld numerous times in state and federal courts; and
WHEREAS, the billboard industry is proposing legislation which would
eliminate the use of amortization by requiring cash payments prior to the removal
of nonconforming billboards; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the Texas Legislature is urged to defeat proposed billboard
legislation as not being in the best interest of the Citizens of Texas because of the
threat it poses to the doctrine of local self determination.
Section 2: This resolution shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 11th day of April, 1985.
