RESOLUTION NO. 870
A RESOLUTION REQUESTING THAT THE U. S. ARMY CORPS OF
ENGINEERS HOLD A PUBLIC HEARING ON THE PERMIT REQUEST
OF TXTX CORPORATION TO DO CERTAIN WORK IN THE HOUSTON
SHIP CHANNEL NEAR THE CITY OF BAYTOWN; AND PROVIDING
FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, TXTX Corporation has requested a U. S. Army Corps of Engineers
permit to do certain dredging working in the Houston Ship Channel near Spilmans
Island and Hogg Island, and near Morgans Point; and
WHEREAS, the purpose of this dredging is to construct a bulk transfer
facility and barge mooring area; and
WHEREAS, it is unknown at this time what effect the proposed dredging or
the operation of the bulk transfer facility will have upon the City of Baytown and
its citizens; and
WHEREAS, some citizens have expressed fears that the proposed activities
will have a detrimental effect to themselves and the City, and
WHEREAS, the City Council of the City of Baytown desires that it have
additional time to investigate the proposals and their possible effects; and
WHEREAS, the City Council of the City of Baytown believes its citizens
should be given a chance to ask questions about these proposals to determine if a
possible problem does exist, and that a public hearing would best address the
concerns of its citizens; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the U. S. Army Corps of Engineers is hereby requested to
conduct a public hearing on the permit being requested by TXTX Corporation, being
Permit Application 16773.
Section 2: That this hearing be granted although it is not made within thirty
(30) days of the written notice, because the City of Baytown did not receive said
notice until thirty-eight (38) days after it was prepared.
Section 3: This resolution shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
