CC Resolution No. 812 1372 RESOLUTION NO. 812 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS , CONFIRMING THE DECLARATION BY THE EMERGENCY MANAGEMENT & PREPAREDNESS COORDINATOR AND THE ASSISTANT EMERGENCY MANAGEMENT AND PREPAREDNESS DIRECTOR OF THE EXISTENCE OF AN EMERGENCY ON THE 18TH DAY OF JULY. WHEREAS , on July 18 , 1982 , an explosion at Chemical Ex- change Company , in Baytown, Texas, occurred, resulting in a large fire and the possible spread of dangerous chemicals; WHEREAS , Section 114-2 of the Code of Ordinances of the City of Baytown provides that the Assistant Emergency Manage- ment and Preparedness Director and the Emergency Management and Prepareness Coordinator may jointly declare the existence of an emergency subject to confirmation by the City Council at its next meeting; and WHEREAS , after an emergency has been declared pursuant to the provisions of Section 114-4 of the Baytown Code of Ordinances , the Emergency Management and Preparedness Coordinator , subject to the approval of the Assistant Emergency Management and Preparedness Director, has certain rule making and supervisory powers which are necessary for the protection of health, safety, and property of victims of disasters ; and WHEREAS , as a result of the aformentioned threat and of the evacuation of the area by numerous residents , and attendant security problems, the Emergency and Preparedness Coordinator and the Assistant Emergency Management and Preparedness Director, deemed it advisable to declare an emergency without delay; and WHEREAS , City Council is of the opinion that an emergency as contemplated by Section 114-2 of the Code of Ordinances did, in fact exist ; NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN. Section 1 . That the City Council hereby confirms action taken by the Emergency Management and Preparedness Coordinator and the Assistant Emergency Management and Preparedness Director 1373 in declaring the existence of an emergency on the 18th day of July, 1982 . Section 2 . This Resolution shall take effect from and after its passage by the City Council of the City of Baytown .
