RESOLUTION 810
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
SUPPORTING LEGISLATION TO EXEMPT MUNICIPALITIES FROM
FEDERAL ANTI-TRUST LAWS.
WHEREAS , municipalities have traditionally been exempt
from anti-trust liability; and
WHEREAS , the Supreme Court of the United States recently
by judicial decision removed this exemption and made anti-
trust laws applicable to municipalities , resulting in possible
anti-trust liability by municipalities for carring forth
traditional governmental type actions ; and
WHEREAS , there are great numbers of municipal activities
that could be held to be in violation of the Sherman Anti-
trust Act , making it difficult for cities to determine the
amount of potential liability they may face ; and
WHEREAS , Congress is considering legislation to provide
a statutory exemption for municipalities from federal anti-
trust laws, therefore restoring the ability of municipalities
to effectively operate as a governmental subdivision ;
NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BAYTOWN.
Section 1 : That the City of Baytown supports the
passage of federal legislation to exempt municipalities from
federal anti-trust laws, and further urges the legislators
representing the Baytown area to pass such legislation .
Section 2 : This Resolution shall take effect immediately
from and after its passage .
INTRODUCED, READ and PASSED by the affirmative vote of
the City Council on this the 22nd day of July
1982 .
