CC Resolution No. 798 1355 RESOLUTION NO. 798 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN TEXAS , REPEALING RESOLUTION NO. 576 ; APPOINTING THE ASSISTANT CITY MANAGER AS DEPUTY TREASURER AND AUTHORI- ZING WITHDRAWAL OF FUNDS FROM THE CITY 'S DEPOSITORY ON CHECKS SIGNED BY THE TREASURER OR DEPUTY TREASURER AND THE CITY MANAGER OR CITY CLERK. WHEREAS , Section 77 of the Charter of the City of Baytown provides as follows : Sec. 77 . Disbursement of funds . All checks , vouchers or warrants for the with- drawal of money from the city depository shall be signed by the city treasurer, or his deputy, and coun- tersigned by the city manager. In the absence of the city manager, checks may be countersigned by the city clerk; and WHEREAS, it is deemed in the best interest of the City to designate a Deputy City Treasurer and the Assistant City Manager should act in that capacity; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : That Resolution No. 576 , passed on May 12 , 1977 , is hereby repealed and declared of no further force or effect. Section 2 : That the Assistant City Manager of the City of Baytown, is hereby designated Deputy Treasurer of the City of Baytown. Section 3 : That funds of the City of Baytown may be withdrawn from the Depository Bank for the City of Baytown, on the check of said Municipal Corporation signed by the Treasurer or Deputy Treasurer and the City Manager, or in his absence the City Clerk, all as provided in Section 77 of the Charter of the City of Baytown. Section 4 : That it is further resolved that any indebt- edness created in connection with the accounts of the City of Baytown by these officers shall be the debt of the City of Baytown. 1356 Section 5 : It is further resolved that the Depository Bank for the City of Baytown is hereby authorized to receive such drafts , checks or order so executed for the credit of , or in payment from the payee of any other holder without inquiry in any case as to the circumstances of their issue, or the disposition of their proceeds . Section 6 : Be it further resolved that said authority hereby conferred shall remain in force until written notice of the revocation of shall be received by the Depository Bank. Section 7 : This resolution shall take effect from and after its passage by the City Council of the City of Baytown.
