CC Resolution No. 7611283 RESOLUTION NO. 761 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS ENDORSING THE PRINCIPAL OF RESOURCE RECOVERY AND ENERGY GENERATION FROM SOLID WASTE AND DECLARING AN INTEREST IN PARTICIPATING IN A RESOURCE RECOVERY PLANT ON A REGIONAL BASIS. WHEREAS, the municipalities within Harris County face an uncertain future with reference to their costs and methods of disposing of solid waste; and WHEREAS, a number of cities and states are planning or building facilities to recover the resources in solid waste, and to recycle them into reusable material and energy pro- ducts; and WHEREAS, in order for such a system to be economically feasible in Harris County, it must be organized on a regional basis; and WHEREAS, Gulf Coast Waste Disposal Authority (hereinafter referred to as "Authority") is preparing preliminary informa- tion for the development of a regional resource recovery facility to serve the needs of the residents of Baytown; and WHEREAS, the preliminary Authority information indicates that the establishment and operation of the facility would provide substantial long-term benefits to the City and its residents; and WHEREAS, the City Council of the City of Baytown, declares its interest in entering into a long-term service agreement with the Authority for the processing of its solid waste at said facility; and WHEREAS, this Resolution is subject to the following conditions: 1. That the City of Baytown shall in no way be obli- gated to furnish or repay any bonds issued for the purpose of funding the construction of the facility; 1284 2. That the Authority shall submit a suggested long- term service agreement for review, study, and, if necessary, negotiation by the City of Baytown; 3. That Tricil Limited, the proposed full service contractor for the facility, obtain a long-term purchase agreement for the sale of recovered energy; 4. That the revenues from the sale of recovered energy and materials are shared, upon a mutually agreeable basis, with all municipal users of the facility; and 5. That this Resolution shall in no way commit the City of Baytown to a contract, but merely declares an interest in the processing of the City's solid waste at the proposed Authority regional waste -to - energy facility upon terms and conditions to be agreed upon by the City of Baytown and the Authority. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council hereby endorses the principal of resource recovery and energy generation from solid waste. Section 2: That the Mayor is hereby authorized and directed to issue to the Authority a letter expressing the City's interest in entering into a long-term contract with the Authority for the processing of solid waste within the control and jurisdiction of the City, subject to the provis- ions of this Resolution.
