CC Resolution No. 710 1156 RESOLUTION NO. 710 A RESOLUTION ADOPTING THE REVISED CITIZEN' S PARTICIPATION PLAN FOR THE 1979 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FOR THE CITY OF BAYTOWN. WHEREAS , City Council approved by Resolution No . 671 the Citizen ' s Participation Plan proposed by the Community Development Advisory Committee ; and WHEREAS , the Department of Housing and Urban Development has requested some changes in the Citizen ' s Participation Plan ; and WHEREAS , the Community Development Advisory Committee has prepared a new Citizen ' s Participation Plan which satisfies the Department of Housing and Urban Development requirements ; and WHEREAS , the City Council has reviewed the revised Citizen ' s Participation Plan and approves of the plan as it is now proposed; NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : The City Council of the City of Baytown hereby adopts the Citizen ' s Participation Plan which is attached as Exhibit "A, " and made a part hereof for all intents and purposes . Section 2 : This Citizen ' s Participation Plan is to replace the Plan approved by Resolution No. 671, which is hereby declared void and of no effect . Section 3 : This resolution shall take effect from and after its passage. HALL, City Clerk APPROVED: SCOTT BOUNDS , City Attorney -2- 1158 E X H I B I T "A" 1159 CITY OF BAYTOWN COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CITIZEN PARTICIPATION PLAN One of the requirements pursuant to the City of Baytown's participation in the Community Development Block Grant Program is that local residents be given an opportunity to participate in determining the City's needs; to express preferences about proposed activities; to assist in the selection of priorities; and to participate in the development of each annual application. The City is also required to answer complaints, requests for information and provide technical assistance in a timely and responsive manner. Pursuant to these requirements and to the City's desire for a maximum of citizen input into the planning of Community Development activities, the following Citizen Participation Plan has been developed. I In order to provide for the maximum feasible amount of citizen participation in the planning, implementation, and operation of the Community Development Block Grant Program, the City Council of the City of Baytown has created the Community Development Advisory Committee (CDAC). This Committee consists of twelve (12) members broadly representative of all elements in the community who are directly appointed by and responsible to the City Council. It is the specific duty of this Committee to implement this Citizen Participation Plan by holding a series of public hearings to solicit citizen input on community needs, goals, objectives, and requests for specific programs or projects. Following these hearings, the CDAC will prepare a report recommending a complete program of activities which they will submit to the City Council for final approval. 1160 IS Each year, approximately two weeks prior to the first hearing of the CDAC on application development for the next annual Community Development Block Grant Application, a notice will be published in the .Baytown Sun, advising residents that planning for the current year's Community Develop- ment Block Grant is underway. The notice will include other pertinent information, such as; the amount of funds expected to be available, generally the types of activities expected to be undertaken, and other important program requirements. Notices of all Public Meetings on the Community Development Program shall be placed in the non-legal section of the Baytown Sun at least ten (10) days prior to each meeting. As required, the procedure shall be followed for all types of public hearings to be held. Residents shall be encouraged to participate in finalizing the application, particularly by articulating their needs, expressing preferences in regard to proposed activities, and assisting in the selection of priorities, either verbally at the meeting, or in writing prior to or after the meeting. They shall be further advised that the Staff of the City's Community Development Office is available from 8:00 A.M. to 5:00 P.M. each working day to explain program requirements, discuss proposed activities, and/or receive and investigate complaints. Residents are encouraged either to attend regularly scheduled meetings of the CDAC when substantive matters relating to the planning and implementation of Block Grant funded activities are discussed or to discuss their feelings or concerns with members of the Committee. 2 - 1i61 : ; III :°E =a Citizens are strongly encouraged to participate in all areas of the .Community Development Program, particularly: A. The development of the three (3) year Community Development Plan which: 1. Identifies problems and needs in the City_ 2. Establishes goals for the community. 3. Establishes short term objectives. B. The development of a Housing Assistance Plan, including the detailed action proposed in the current year. C. The specific program of activities to be undertaken during the current program year to include all ultimate expenditures of project funds. The citizen members of the Community Development Advisory Committee (CDAC) are responsible for preparing recommendations to the City Council covering the following items. 1. An assessment of current community needs at both city wide and neighborhood levels. 2. A comprehensive strategy aimed at developing realistic goals and objectives for meeting the needs previously identified. 3. Developing specific project proposals both for a three (3) year and immediate one (1) year periods to bring about the achievement of identified goals and objectives. 4. To develop goals for housing assistance by type and location for both a three (3) year period and an immediate one (1) year period. 3 1162 All citizen input at neighborhood and centralized public hearings and all written comments and suggestions will be utilized by the CDAC in developing these recommendations. Citizen input is divided into three (3) fundamental areas outlined in this plan: , 1. Planning the Program - as previously outlined, citizens through public hearings will be given an opportunity to assist in the planning of the three (3) year and one (1) year community development programs and to assist in the preparation of the application and housing assistance plan. 2. Implementing the Program - During the course of the program year as minor changes are made in individual projects and as funds are reallocated, citizens will be given an opportunity to participate in implementation when public hearings are required will be held before the CDAC to consider program changes. 3. Monitoring the Program - During each of the quarterly monitoring hearings, after the program is implemented, citizens will be given an opportunity to comment on program and project effectiveness. Additionally, at any time during the program year, citizens may file written comments with any member of the advisory committee or with members of the City Council or the Community Development Office. The Annual Performance Report on the community development program will be approved by the CDAC at a public hearing. - 4 - ixs3 IV Each regular business meetings of the Community Development Advisory Committee shall be open to the public. Notices will be posted at the City Hall and other places openly accessible to the public at all hours, and notification in the local newspaper. These notices shall provide all necessary information about the meeting, including an agenda. The notices shall be posed at least seventy-two hours prior to the day the meeing is to be held. In addition, each meeting of the City Council, where the development or submission of an annual application is to be discussed or considered., shall be convened following the previously specified procedure. V Residents shall be encouraged through the publication of this plan, through personal contacts by Community Development Advisory Committee (CDAC) members, by notices of public hearings, through the news media, and other means available to participate in the development of the application prior to its submission. Attached hereto is a list of the names of all members of the CDAC. Residents will be given an opportunity to participate at each public hearing and each business meeting of the CDAC. The complete application process will culminate in the development of: I. A complete community profile detailing the history, demography, physiography, and economic base of the city in a general sense (HUD Form - 7062) . 2. A comprehensive statement of community needs explaining both city _ 5 _ 1164 wide needs an individual neighborhood needs. (HUD Form - 7063) 3. A comprehensive community development strategy explaining city wide goals and objectives and individual neighborhood goals and objectives. (HUD Form - 7064) 4. Every third year the city will prepare a three year program summary outlining a general list of projects to be undertaken during the three year period. (HUD Form - 7065) S. Each year the city will prepare individual project summaries on each project to be undertaken during the coming year. (HUD Form - 7066) 6. Each year the city will prepare a cost summary and budget for the projects to be undertaken that year. (HUD Form - 7067) 7. The city will prepare a Housing Assistance Plan consisting of a. Table I (A survey of existing housing conditions) (HUD Form - 7091) b. Table II (An analysis of the housing assistance needs of lower income residents of the city) (HUD Form - 7092) c. Table III (A three year goal for providing necessary housing assistance)' (.HUD Form - 7093) d. Table IV (A selection of possible locations for the proposed assisted housing) (HUD Form - 7094) e. Table V (An annual assistance goal outlining assistance to be provided during the coming year) (HUD Form - 7095) VI Technical assistance in understanding the various program requirements or any other substantive matter relating to the program is available from 8:00 A.M. to 5:00 P. M. each working day from the Staff. Only English - 6 - 1165 explanations of this information will be available. If a citizen or citizens group desire to prepare a specific program or l project proposal for consideration by the CDAC and desires technical assistance on a proposal, such as, planning or informational services, he may secure this assistance in the following manner: A written request for technical assistance must be made to the office of the Community Development Planner no later than October 1 of that program year. The request must give a .general description of the proposed program or project and specify what type of assistance is needed. If the assistance is available from within the City Administration, it will be provided in the form of a written report to the citizens or group. If the assistance must be secured from an outside source, the Staff will present the request for assistance .to both the CDAC and the City Council to secure their authorization to obligate the funds necessary to cover the cost of such assistance.. If both bodies approve the use of outside resources, the City Staff will select the Consultant under the guidelines and conditions which they feel are appropriate. All material provided by the Consultant shall be submitted to the Community Development Planner for transmittal to the citizen or group concerned. If the request for outside resources is rejected - all attempts will be made to provide information on similar projects in the area. j - 4H In addition, all explanatory or technical material distributed.to the CDAC or City Council, is available at the office of the Community Development Planner or to the general public at any of the meetings of these bodies. Furthermore, copies of all Community Development Block Grant Applications (including past years), Annual Performance Reports, Housing Assistance Plans and The Citizen Participation Plan are available for public inspection at the 4 following locations during normal business hours: 7 - 1166 1. Department of Planning and Traffic, 2401 Market Street 2. Sterling Municipal Library - Public Library Avenue General Program correspondence with HUD and Environmental Review Records are available for public inspection only at the Department of Planning and Traffic, 2401 Market Street, during normal business hours. VII The City encourages all interested citizens or groups to present any views or proposals to the City for consideration under the Community Development Block Grant Program. Material may be submitted in any of the following methods: 1. By letter to the City of Baytown, Attention: Community Development Planner, P. 0. Box 424, Baytown, Texas 77520 2. By oral presentation or delivery of written comments to the City Staff at any meeting of the Community Development Advisory Committee (CDAC) or any City Council meeting. 3. By oral presentation or delivery of written comments to the City Staff at any public hearing held on the Community Development Block Grant Program. 4. By telephone request to the Community Development Planner at 713/422-8281, at any time during normal working hours. All citizens or groups making comments or proposals are asked to leave their name and address with the City Staff so that they may be provided with a written response to their comments or proposals, if they so request. The City will provide a written response to all comments received within fifteen (15) working days of their receipt. If a final response is not 8 - 1167 possible within this period of time, an interim response will be given providing what information is currently available. All comments or proposals will receive a final notice of disposition as soon as possible. VIII Any written complaint made about the Program, which deals with; preparation of the application, selection of projects, citizen participation opportunities, environmental review, or the effectiveness or appropriateness of on-going programs or projects, shall be answered with a written response within fifteen (15) working days of the date upon which the complaint was received. Citizens may object to approval of the application by contacting HUD within thirty (30) days of publication that the application was submitted. Grounds for objection are that the City did not comply with regulations or that the City misrepresented facts on the application. The mail address is Department of Housing and Urban Development 2001 Bryan Tower - Fourth Floor Dallas, Texas 75201 IX All projects and programs undertaken with Community Development Block Grant Funds shall be continuously monitored and evaluated by the Community Development Advisory Committee (CDAC) . This Committee shall hold a minimum of one meeting every ninety (90) days for the purpose of reviewing the overall status of the program. Each quarter, the Committee shall forward a summary report of their current program evaluation to the City Council. All meetings held for the purpose of monitoring and evaluating the on-going Community Development Program shall be conducted as public hearings, in which proper - 9 - 1168 notice is posted and all citizens shall have the opportunity to present comments. The Annual Performance Report prepared each year by the City shall include: 1. Copies of citizen comments regarding Community Development performance. 2. City staff assessment of those comments. 3. Summary of action taken in response to those comments. Copies of the performance reports will be on file as indicated in Section IV. Any citizen desiring a personal copy of the performance report may secure one by requesting it in writing to the Office of the Community. Development Planner. The CDAC shall solicit comments from all concerned citizens at each monitoring and evaluation meeting. The Committee will utilize these comments to direct the preparation of the Annual Performance Report. All written comments received by the City relative to program performance-will be forwarded to the CDAC at it's next monitoring and evaluation meeting. The CDAC will be responsible for reviewing the Annual Performance Report before it is submitted to the HUD area 11 office. X During the process of developing each annual Community Development Application, the Community Development Advisory Committee (CDAC) will hold a minimum of two (2) neighborhood public hearings in different geographic areas of the Community. Whenever possible (subject to site availability), these hearings will be held in or near the Neighborhood Strategy Areas, _ or the locations of proposed activities or projects. r. ' 10 _ 1169 XI s4 The development of subsequent amendments to the Community Development } Program, including the reallocation of funds or the planning and implementation . of new activities, will also be done according to the procedure previously described, so as to give residents maximum opportunity to participate in these actions as well. XII The City .will not make information relating to the Community Development Program or projects available in a Spanish translation. Vhenever possible, and upon request, when a significant portion of the neighborhood is Spanish speaking, an effort will be made to have the Spanish speaking members of the CDAC available for translation purposes during the meetings. XIII Citizens likely to be affected by Housing and Community Development activities will be given an opportunity through council meetings, public hearings, personal contact etc. , to articulate their needs, express preferences about proposed activities, assist in the selection of priorities, and otherwise participate in the development of the application, and the development of program amendments (including reallocation of funds and/or planning of new activities). As virtually every citizen of Baytown will be affected by Comtm mity Development activities to one extent or another, all local residents are encouraged to participate in the planning and implementation of Community Development activities. Interested citizens are encouraged to attend regular meetings of the Community Development Advisory Committee or visit the Community Development Office located in the Baytown City Hall. 11 1170 XIv Specifically required for Cities with population over 50,000 persons is a neighborhood citizen 'participation procedure. In addition to the methods already detailed in this document, the CDAC shall hold not less than one public hearing in the neighborhood where the highest percentage on annual CDBG funds is anticipated to be allocated. The CDAC may select to hold other meetings in the neighborhoods, based on fund allocations.
