RESOLUTION NO. 674
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS , AUTHORIZI14G LOCAL SPONSORSHIP OF CORPS OF ENGINEERS ,
BAYTOWN, TEXAS PROJECT.
WHEREAS, the United States Army Corps of Engineers has
developed a plan for reducing flood damages in the Burnett ,
Crystal , and Scott Bays area of Baytown , Texas ; and
WHEREAS, before the plan can be approved by the Chief
of Engineers , it is necessary for local interests , acting
through a public body , to furnish the Corps of Engineers
appropriate assurances that the requirements of local cooperation
will be met ; and
WHEREAS, the City Council of Baytown , Texas , is such a
public body, representing local interests ; NOW THEREFORE ,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS :
Section 1 : That the City Council of the City of Baytown ,
Texas , favors the project as presented in the Baytown ,
Texas , Phase I , Phase II , and Real Estate Design Memorandum.
Section 2 : That , subject to voter approval at an
election on the Baytown Project , the City Council declares
its intention to furnish or cause to be furnished the following
requirements of local cooperation :
(a) Share in the cost of the project in an amount
equal to 20 percent of the final first cost
within the City limits of Baytown ;
(b) Hold and save the United States free from
damages that may result from implementation
and management of the project , not including
damages due to the fault or negligence of the
United States or its contractors ;
(c) Assume public ownership and management of the
project lands , and costs of management ,

including policing , safeguarding of public
health and safety , road maintenance , and
regulation of the future uses of these lands
as nature areas or for passive uses consistent
with the high potential for recurrent flooding
and the flood damage prevention objectives of
the project ;
(d) At least annually inform affected interests
regarding the limitations of the protection
afforded by the project ; and
(d) Enforce flood plain management regulations
for the projected 100-year flood plain to
minimize future flood damages , consistent
with regulations required for participation
in the National Flood Insurance Program.
Section 3 : This resolution shall take effect immediately
from and after its passage .
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown , Texas , this the loth day
of May 1979.
