RESOLUTION NO. 671
A RESOLUTION ADOPTING THE CITIZEN' S PARTICIPATION PLAN
FOR THE 1979 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
FOR THE CITY OF BAYTOWN.
WHEREAS , the Community Development Advisory Committee
prepared the Citizen ' s Participation Plan which is attached
as Exhibit "A" and made a part hereof for all intents and
purposes ; and
WHEREAS , the City Council has reviewed the Citizen ' s
Participation Plan and approves of said plan as it is proposed;
NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN :
Section 1 : The City Council of the City of Baytown
hereby adopts the Citizen ' s Participation Plan which is
attached as Exhibit "A" and made a part hereof for all
intents and purposes .
Section 2 : This resolution shall take effect from and
after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown on this 26th day
of April 1979 .

Citizens Participation Plan
1979 Community Development Block Grant Program
This plan sets forth how maximum citizen participation (CP) will be
achieved in planning, implementing and assessing the City's Community
Development Block Grant Program and performance.
The CP plan will include the processes to be followed throughout all stages
of the community development program (i.e. preapplication stage, application stage,
environmental review stage, implementation stage and final evaluation and closeout
stage) . These General Policies, where applicable, shall apply throughout all
stages of the program.
A. General Policies
1. Citizen review, comments, proposals and/or inquiries are
encouraged and solicited, particularly from low and moderate
income persons, members of minority groups, residents of target
areas, handicapped, also the business community and civic groups.
Oral views, comments, proposals and/or inquiries will be responded
to orally, where possible, while written views, comments, proposals
and/or inquiries requiring or requesting a response will be acted upon
within ten (10) working days after its receipt to every extent
practicable.
2. Adequate notices of public hearings and meetins concerned with the
Community Development Program shall be provided. Such notices shall
be published in the BAYTOWN SUN newspaper, and posted on available
bulletin boards throughout the City and especially in concentrated
low and moderate income and minority areas, when these bulletin boards
are available.

Arrangements for radio announcements, where deemed appropriate,
will be made. Such notices shall indicate the date, time, place,
purpose of the hearing and topics to be considered. Arrangements
will also be made for announcements at Churches serving the target
areas.
3. Hearings to obtain citizen views and respond to citizen proposals
shall be held at times and locations which will allow broad
participation of representatives of low and moderate income persons,
minority groups, and project area residents. When procedure requires
more than one hearing, at least one of the hearings will be held
within or at a place easily accessible to the residents of the
proposed project or target area(s) . Bilingual opportunities will
not be provided at public hearings. Arrangements will also be made
possible for the full participation of handicapped citizens.
4. Adequate program information will be provided at all stages of the
City's involvement in the Community Development Program. Full
public access to program information and records is provided during
normal working hours, consistent with State and local laws regarding
personal privacy and obligations of confidentially. In addition,
documents and records of most interest to citizens (i.e. citizen
participation plan, proposed and approved applications, the annual
performance report, etc.) shall be placed at a location convenient
to project area residents. Citizens shall be notified as various
documents become available for review and inspection.
S. Technical assistance will be provided to citizens organizations, groups
of low and moderate income persons, groups of residents of blighted
neighborhoods which request assistance so that such groups may
adequately participate in the planning, implementation and assessment

of this program and develop proposals and statements of views.
This assistance will be limited to program information, proposed
types of projects and eligible and ineligible projects.
6. Complaints received in writing concerning any aspect of the program
or proposed projects will be responded to in writing within 15 days
to the extent practicable. To all extent possible verbal complaints
will be responded immediately.
B. Preapplication Stage
1. The City, on March 22, 1979, adopted a resolution appointing William P.
Cornelius, Jr. temporary Community Development Director. The City Council
in regular Session has adopted this Citizen's Participation Plan by
Resolution # , dated April 26, 1979, and authorized execution
of the necessary forms to apply for FY79 funds.
2. There will be two public hearings, the purpose of which are (1) to
obtain the views and proposals of citizens with regard to the deter-
mination of priorities and community development and housing needs
and (2) to plan and develop the City's application. The first public
hearing was held in the City Hall at 7:00 p.m. on March 7, 1979. The
second public hearing was held in the City Hall at 7:15 p.m. on March 12,
1979.
3. A notice will be published in the BAYTOWN SUN and posted on bulletin
boards, where they are available and deemed appropriate to the program.
Such notice shall explain the purpose of the hearing, the time, location
and the topics to be considered.
4. An information packet will be provided at each hearing containing
information as to:

(a) Grant limits, when available
(b) Deadlines to be met, if available
(c) Eligible and ineligible activities
(d) Citizen Participation Plan Summary
(e) Criteria for selection and rating system
(f) Other important program requirements
(g) Other information, if requested in advance
(h) A status report on past Community Development activities, if applicable.
S. The City, on March 22, 1979, adopted a resolution adopting the City of
Baytown, Texas Community Development Program of 1979: Directing the Director
of Planning and Traffic to sign and forward necessary documents and extending
thanks to the program participants. In addition, the City shall select
the location(s) of additional documents as required in Section A.4.
C. Application Stage
1. The City Council shall appoint a Community Development Advisory Committee
containing twelve (12) citizens, at least eight (8) of which will be low
and moderate income residents of the City. Minority groups will at least
be represented in proportion to such citywide percentage representation.
2. The City's Community Development Advisory Committee shall function
throughout the life of the program and hold public hearings and meetings
to advise citizens of the status and other matters pertaining to the program.
The Advisory Committee shall also report and make recommendations to the
City Council as to the status and such other matters. The City's Community
Development Director and staff shall assist the Advisory Committee.

3. Prior to the preparation of the City's application, the Advisory
Committee shall hold at least one public hearing or meeting to be
concerned primarily with the preparation of the City's Three-Year
Community Development and Housing Assistance Plans and to obtain
comments on the City's Community Development Performance. Printed
program information, as deemed appropriate and necessary shall be
provided.
4. Public notice of such hearing(s) or meeting(s) will be published
as required in Section A.2. in the non-legal section of newspaper
at least ten (10) days prior to such hearing(s) or meeting(s).
S. The Advisory Committee shall prepare and recommend a draft Community
Development application to the City Council.
6. The City Council shall adopt a resolution authorizing the filing of
such application.
7. Persons wishing to make objections to the application may made such
objections to the DHUD, 2001 Bryan Tower, Dallas, Texas, 75201. HUD
will consider objections made only on the following grounds:
a. The proposed needs and objections are plainly inconsistant with
available facts and data; or
b. The proposed projects to be undertaken are plainly inappropriate
to meeting the needs and objections; or
c. The application does not comply with CDBG requirements or other
applicable laws; or
d. The application proposes projects which are ineligible.
D. Environmental Review Stage
1. Upon notification that the City's Application has been approved,
the City's Advisory Committee shall prepare a draft environmental

assessments as required by the Environmental Review Procedures
for the Community Development Block Grant Program (24 CFR Part 58) .
2. The City shall adopt an environmental review assessment by resolution
prior to the required publications.
E. Implementation Stage
1. In the event any amendments in the approved application requiring
prior approval by the Federal funding agency becomes necessary,
the following procedures will apply:
(a) There will be at least two (2) public hearings or meetings
on such proposed amendments.
(b) The public hearing notice procedure as described in Section
C.4. shall be followed.
(c) The Community Development Advisory Committee shall prepare
a draft amendment and recommend such amendment to the City
Council.
(d) The City Council shall adopt such amendment by passage of a
resolution authorizing the filing of such amendment.
2. The City's Community Development Advisory Committee shall hold
public hearings or meetings, from time to time, as deemed necessary
and appropriate to advise project area residents and the general
public of budget revisions, changes and status or progress of the
program and the housing assistance plan.
3. The public hearing notice procedure as described in Section C.4.
shall be followed.
4. Progress or status reports shall be made to the City Council at
intervals of not more than 90 days throughout the life of the program.

F. Final Evaluation and Closeout Stage
1. Prior to the completion of and toward the end of the program,
the Community Development advisory Committee shall hold at least
two (2) public hearings and meetings, for the purpose of assessing
the City and its contractors performance in the program.
2. The public hearing notice procedure as described in Section C.4.
shall be followed.
3. At a later and predetermined time, the Advisory Committee shall
present a report of the Citizens Assessment of the City's Performance
in the Community Development Block Grant Program. Such report shall
also contain a draft Grantee Performance Report.
