CC Resolution No. 670 1068 RESOLUTION NO. 670 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN EXPRESSING THE CITY' S DESIRE TO PARTICIPATE IN A PRO- POSED PROJECT TO EXTEND WATER AND SEWER SERVICE TO THE PROPOSED SAN JACINTO MALL AND LAKE MUNICIPAL UTILITY DISTRICT. WHEREAS , the developers of San Jacinto Mall and Lake Municipal Utility District have requested the City to supply them water and sewer service ; and WHEREAS , providing the requested service would be in the public interest in that it would aid orderly growth and would remove a source of possible wastewater pollution ; and WHEREAS , the entities requesting this service have agreed to pay the cost of constructing the facilities necessary to provide the requested service and dedicate all the facilities to the City after satisfactory completion of the work ; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : The City Council of the City of Baytown hereby declares its desire to reach an agreement with the developers of San Jacinto Mall to provide water and sewer service to the proposed San Jacinto Mall . Section 2 : The City Council hereby declares its desire to provide water service to Lake Municipal Utility District , and further declares its intent to discuss with Lake Municipal Utility District the possibility of providing sewer service . Section 3 : The City of Baytown is willing to act as contracting agent for the proposed construction , and is also willing to accept alternative bids for construction so the City may elect to participate in the cost of installation of larger water and sewer lines , with the City ' s cost being only the difference between the larger lines and the proposed lines. 1069 Section 4 : The City declares it has the capability to accept the additional wastewater from the proposed San Jacinto Mall , and if a suitable agreement is reached with Lake Municipal Utility District , capacity sufficient to accept their wastewater will be added. Section 5 : The City Council hereby expresses its intent to annex the area containing the proposed San Jacinto Mall. Section 6 : The City Council proposes that efforts toward supplying the requested service be made on the following tentative time schedule : contract negotiation to begin by May 16 , 1979 ; contracts to be presented to City Council on May 24 ; bids to be accepted on June 21 ; San Jacinto Mall and Lake Municipal Utility District to contribute funding and contract to be awarded on June 28 ; construction to be completed by October 15 ; and service to begin on November 1 , 1979. Section 7 : The City Manager is hereby authorized and directed to prepare proposed agreements consistent with the intent of this resolution with Lake Municipal Utility District and the developers of San Jacinto Mall for review by the City Council .
