CC Resolution No. 655 1041 RESOLUTION NO. 655 A RESOLUTION ACCEPTING THE WEST MAIN STREET BRIDGE AND ACCEPTING CONDITIONS FOR MODIFICATION OF THE BRIDGE. WHEREAS , the City Council of the City of Baytown has proposed to construct a pedestrian walkway across the Goose Creek Stream adjacent to the existing West Main Street bridge; and WHEREAS , in order to get the necessary permits to modify the bridge, the City must accept ownership of the bridge from Harris County; and WHEREAS, the City must also accept further conditions as set out by the U. S. Coast Guard in a letter dated August 3, 1978; NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : That the City Council accepts ownership of the West Main Street bridge from Harris County for and on behalf of the City of Baytown. Section 2 : That the City Council acknowledges and accepts that : a. The West Main Street bridge is not presently in conformance with the original permit requirements pertaining to the vertical clearance , due to subsidence; b. Approval of the walkway modification to the existing bridge in its subsided condition does not in any way constitute a repudiation of the original permitted vertical clearance; C. In the event future navigation warrants , the modified bridge shall be restored to its original permitted vertical clearance, at the owner ' s expense; d. The required fender system, which is in a state of disrepair , provides for a horizontal clearance of 56 feet , while the proposed walkway would provide a clearance of 50 feet . The fender system shall be reconstructed to conform to the original permit requirements, or the fender system deleted from the permit drawing and the remnants of the original fender construction removed entirely from the waterway. If the fender system is retained, the horizontal clearance between the walkway supports within the channel shall be no less than the clearance between fenders. 1042 Section 3 : That this resolution shall take effect immediately from and after its passage.
