CC Resolution No. 631 998 RESOLUTION NO. 631 A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO TAKE ALL APPROPRIATE LEGAL ACTION TO REPRESENT THE CITY OF BAYTOWN AND ITS CITIZENS CONCERNING THE HOUSTON LIGHTING & POWER COMPANY RATE INCREASE APPLICATION BEFORE THE PUBLIC UTILITY COMMISSION OF TEXAS . WHEREAS , the Texas Public Utility Commission , under the authority of the Public Utility Regulatory Act of 1975, has exclusive appellate jurisdiction to review orders or ordin- ances of municipalities regulating rates of an electric public utility; and WHEREAS , the Texas Public Utility Commission has exclusive original jurisdiction to set rates of an electric public utility in unincorporated areas; and WHEREAS , Houston Lighting & Power Company applied for an increase in rates within the City of Baytown to the City of Baytown and outside the City of Baytown to the Public Utility Commission on July 14, 1978 ; and WHEREAS , the City of Baytown must be a party before the Public Utility Commission in order to have standing to appeal the decision of that body to the Court if the rates set by the Commission are not fair and reasonable to City of Baytown consumers ; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : That the City Attorney be and hereby is authorized on behalf of the City of Baytown and its citizens to intervene in the proceedings before the Texas Public Utility Commission concerning the application of Houston Lighting & Power Company for increased rates and charges in the unincorporated areas . Section 2 : That the City Attorney be and hereby is authorized to take all appropriate legal action in the 999 courts to represent the City of Baytown and its citizens concerning the application of Houston Lighting & Power Company for increased rates and charges. Section 3 : That the City Attorney be and hereby is authorized to coordinate Baytown ' s efforts with other cities affected by the application of Houston Lighting & Power Company for increased rates and charges.
