WI IEREAS, Section 252.022 ofthe 'Texas Local Ciovernment Code exempts front competitive bidding
requirements procurements necessary to preserve or protect the public health or safety ofthe (.7ity's residents; and
WHEREAS, two (2) blowers and one (1) motor care needed to replace broken parts th,tt supply air to the
aeration basins I'm the treatment process with the Baytown Central District Wastewater Treatment Plant (the "Plant"),
and
WI-IEREAS, the replacement parts are necessary in order to ensure the continued functionality ofthe Plant in
order to preserve or protect the public health or sal ;qty of the City's residents; NOW TTI 17 R E' FORE

Section 1: That the City Council ofthe City ofBaytown,'11'exas, hereby declares that the purchase of
two (2) blowers and one (1) unotor for the Baytown Central District Wastewater 'Treatuneril Plant is necessary to
preserve or protect the public health or safety or the Citys residents.
Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes payment in (lie
amount ofFIGI ITY-EIGHT THOUSAND t-AGHT HUNDRED THIRTEEN ANI) NO/I 00 DOLLARS
($88.813.00) to Coastal Pump Services, Inc., for the emergency purchase of one (1) rebuilt blower, one (1) new
blowcr,and one (1) new motor for the Baytown Central District WastewaterTreatment Plant.
Section 3: That P111-Sliant to the provisions ofTexas, Local Government Code Annotated § 251048, the
City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in
costs of lAF`fY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, SUbjCCt to the provision that the
original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than
twenty-five percent (25%) without the consent of the contractor to such decrease.

the City of Baytown.
