PAYMENT OFTHE SUM 017 I"IFTY-FOUR THOUSAND AND NO/] 00 DOLLARS ($54,00(f.00) TO CLARKE MOSQUITO CON-rROL, AST III; SOLE SOURCE, FOR THE PURCHASI1' OF READY-TOAJSI.� PYRETHROID WITH SYNf`RGIST-ULV; MAKING OT111"IR PROVISIONS RELA'FED THERETO; AND PROVIDING DATE THE'REOF. ** ** * * * * 4, * * * * * * * ** * * ** * * * * * *** *** * * ** * * * ** 4: * * * **:* * * * * * * * * * * ** ** * * ** * ** * * * * ** * * *44 WI IEREAS, the following were awarded portions of the Annual Mosquito Control Contract on July 23, 2009, pursuant to competitive bidding procedures, which contract included an option by the parties to renew for additional one-year periods. ; and WHEREAS, such contract was renewed on May 27, 2010, June 23, 2011, and July 12, 2012, and can be renewed again for an additional one-year term; and WHEREAS, the following companies have indicated their willingness to renew the contract for an additional year under the same terms and conditions,, which allow for the following price increases: WHEREAS, the Administration has reviewed the market conditions and recorrimends renewal of the above- re fe renced items as being in the best interest of the City; and WHEREAS, Item 5 of tile Annual Mosquito Control Contract, which is for Ready -To -Use Pyrethroid with Synergist-ULV can no longer be purchased from Public Health Fquipment & Supply Company, Inc., as it is now as Sole Source item which must be purchased directly through its ruallL&ICtUrer — Clarke Mosquito Control,' and WHEREAS, Texas Local Government Code Annotated §252.022 provides that when tile reqUirenlentS Ofthe City Call Only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the procurement of Ready -To -Use Pyrethroid with Synergist-ULV can be satisfied by only one source, Clarke Mosquito Control; NOW THEREFORE BE IT ORDAINED BY 1"I11' CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City COLInCil of the City of'Baytown hereby renews the Annual Mosquito Control Contract with Adapco, Inc., for Item Nos. 10 and 13. Section 1 That the City Council of the City of Baytown hereby, renews the Annual Mosquito Control Contract with "target Specialty Products, 17k/a B & G Chemicals & Equipment Co., Inc., for Item Nos. 3,, 4, and 12. Section 3: That the City Council of tile City of Baytown hereby renews the Annual Mosquito Control Contract with UNIVAR USA, Inc., for Item Nos. 1, 8 and 9. Section 4- That the City Council of the City of aytown hereby authorizes payment in an amount not to exceed FORTY-SIX T[ IOUSAND AND NO/ 100 DOLLARS ($46,00f 0.00) for the items referenced in Sections I through 3 of this ordinance as part of the Annual Mosquito Control Contract. Section 5: That the City Council of tile City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City fior Ready-To-Use Pyrethroid with Synergist-UL. V. Section 6: That the City Council of the City of" Baytown, Texas, authorizes payment of the sung of FIFTY-FOUVITIOU SAND AND NO/] 00 DOLI-ARS ($54,000.00) to Clarke Mosquito Control, as the sole Source, for tile purchase of Ready-To-Use Pyrethroid with Synergist-ULV, . Section T.
