Section l: That the City Council does hereby authorize Change Order No. 5 with LEM
Construction Company, Inc.. for the West District 11'astewater Treatment Plant Expansion Project. A copy of
said change order is attached hereto,marked I Exhibli "A"and made a part hereof for all intents and purposes.
Section 2: That the City Council of the City of Baytown hereby authorizes the payment in the
amount of SIX HUNDRED TI IIRTY-TWO THOUSAND SIX HUNDRED SIXTY-11IREE AND 64I100
DOLLARS($632,663.64)to LEM Construction Company,Inc.,for Change Order No. 5 for the West District

ATTACHMENT A
L 20"Backflow Valve in Header—Attachment B
• Discussed In RFI#74.
• As designed,no separation exists between the blowers for the new plant and the blowers
for the old plant. 'Therefore,there Is no way to isolate the old plant air from the new plant
air,and if one plant should ever need to have air shut down then all the valves would need
to be closed on that plant to Isolate it. To address this situation,the contractor will place a
20"backflow valve at the 2rx20"reducer Just past the 1W air drop to the new contact
chlorine basin(CCB). This will allow plant personnel to Isolate each plant with only one
valve to turn.
• Cost includes purchase and installation of the 20"backflow valve.
2. Belt Press Controls—Attachment C
• Discussed in RFI#72,Part 1 of 2.
• The question In part 1 of RFI#72 from the Contractor asked the Engineer to Identify the
control sequence for the level transmitter in the sludge holding tank and what equipment it
shall control. It was not clear to the Contractor that the tank level transmitter signal
activates or deactivates the new digested sludge pumps or the existing digested sludge
pumps. The Contractor believed the level transmitter signal from the sludge holding tank
would govern the operation of the digester pumps in AUTO,and asked for confirmation
from the Engineer.
• In response,the Engineer directed the Contractor to provide a new control panel in the belt
press room for sludge tank fill control. The panel Is to be located near the proposed sludge
tank level transmitter or at a location selected by plant personnel. This new control panel
will address all concerns surrounding control of the digested sludge pumps.
• Cost Includes purchase and installation of a new aforementioned control panel.
3. Add Polymer Pump Installation—Attachment D
• Discussed in RFI#72,Part 2 of 2 and the revised response to RFI#76.
• The contract specifications for the polymer system state that the Contractor is to provide a
total of three polymer skids in the belt press room. However,Sheet 32 of the contract
drawings shows the Contractor to install only one skid.
• The Engineer,after discussions with the City,gave direction to the Contractor to replace the
existing polymer system with one of the new skids,install a second new skid as shown in the
plans,and to keep the third new skid In the belt press room as a spare with no connections.
• Cost includes removal of existing polymer system and installation of a new skid. Second
Installed skid already included in base contract.
4. Add Site Lighting and Blower Wall Packs—Attachment E
• The contract drawings only included the installation of two overhead site lights for the
entire plant area. Due to safety concerns at night,the City requested the Contractor to
provide additional 25'high light poles to adequately light the plant site. The City also
requested the light fixtures match the LED lights used currently at the Baytown BAWA plant.
• The Contractor provided pricing to install a total of eight 25' high LED light poles at various
locations around the plant site. Additionally,the Contractor priced the placement of three
wallpak light fixtures to be placed on the exterior of the blower building at the request of
plant personnel.
• Cost Includes installation of the three wallpak lights and eight 25'high LED light poles
Including conduit and wire needed in duct banks.
5. Effluent Tower Sampling Station Vault—Attachment F
• Per TCEQ requirements,the City must take direct fluid samples from the effluent splatter
box. The normal fluid level in the effluent splitter box will be below ground level;therefore,
an above ground spigot on the side of the box would not be adequate,and a pump to lift
the fluid up to the spigot would be in conflict with TCEQ requirements for the direct sample.
At the Chys request,the Engineer provided a design fora below ground vault on the side of
the effluent splatter box which plant personnel could enter to take direct fluid samples from
a spigot that would be below the normal fluid level.
• Cost Includes installation of the concrete below ground vault on the side of the effluent
splitter box and a sampling spigot.
6. Sanitary Drain Lines—Attachment G
• Discussed in RFI#78.
• Due to uncertainty during the design process surrounding as built information,If the existing
Influent line and lift station are plugged and abandoned as shown on the contract drawings,
some of the existing plant-drains will not drain to the lift station which is not an acceptable
situation. To rectify this situation the Engineer provided a rerouting of the sanitary drain
lines to place a new 8"line from an existing manhole near the existing lift station to a
proposed sanitary manhole tapping into an existing 8"sanitary lane. This will allow
acceptable sanitary drainage throughout the plant site.
• Cosa includes core into existing manhole,placement of new 8"sanitary line,and installation
of a new sanitary manhole on an existing 8"sanitary line.
7. Scum Controls,Power,and Space Heaters—Attachment H
• Discussed in RFI#77 and RFI#82.
• In RFI#77 the Contractor stated the drawings show floats to control the SCUM and WAS
pumps,but the existing plant's SCUM and WAS pumps are controlled by timers. The
Contractor's question was what type of control does the City want to control the new SCUM
and WAS pumps.
• The Engineer responded that the City requires timers for operation of the WAS and SCUM
pumps to ensure even wear for all three motors in both one and two pump operating
modes,and gave direction the installation of the timers.
• In RFI#82,the Contractor stated it was not dear an the contract drawings how to provide
power to the WAS and SCUM pump panels. The Engineer gave direction on conductor
placement to provide the power an question to the pumps panels. Additionally,the
Engineer provided direction for wiring to route power to the motor heaters which was also
not dear in the contract drawings
• Cost includes purchase and installation of timers for operation of WAS and SCUM pumps,
and providing power to the WAS and SCUM pump panels and associated motor heaters.
S. Move L/S and Eff P/S Panels—Attachment I
• Discussed in RFI#57 and#57A
• In RFI#57 LEM brought forth an Issue which was delaying the completion of the MCC2
building. Essentially the contract drawings gave conflicting direction showing the starters
for the lift station pumps to be installed within the MCC gear as well as within the Digigage
panel. Both the MCC gear and the Digigage panel were submitted showing inclusion of the
starters for the lift station pumps,and both were approved by the engineer. Since only one
starter can be utilized for each pump,LEM asked the engineer what their intent was. The
engineer Shrader responded that the intent of design was for the MCC gear to house the
starters for the pumps,and the digigage panel was intended for controls only.
• City reps Including Gerald Gutierrez met LEM on site so that LEM could explain their solution
to the above issue which was to rewire the dlglgage control panel and remove the starters.
While on site,Mr.Gutierrez told LEM that in addition to addressing this Issue,both the
Influent and effluent lift station control panels should be moved from MCC2 and MCC3 to
their respective lift stations. This will allow City plant personnel to better monitor the
pumps. At that point the engineer was asked to provide a response to RFI#57 that would
Include moving the influent and effluent lift station control panels. Shrader responded with
the RFI#57A directing the contractor to move the influent lift station control panel from
MCC2 to the influent lift station,and with the attached response labeled"effluent lift
station control panel relocation"directing the contractor to move the effluent lift station
control panel from MCC3 to the effluent lift station.
9. Add IV Panels and XFRMS—Attachment J
• Discussed In RFI#87
• In RFI#87,the Contractor states they believe an additional panel and XFRM transformer is
required in MCC1 because the A/C units are low voltage 230V feeds,and the existing XFRM
transformer and panel Is too crowded already to accept the amperage of the new A/C units.
Also,the Contractor states an additional panel and XFRM transformer Is needed in MCC2 to
accommodate the fluid detection systems for the Moyno pumps,the power feeders for the
SCUM and WAS pumps,and to lighten the amperage loads.
• The Engineer agreed with adding the panels and XFRM transformers to MCC 1 and MCC2.
• Cost includes purchase and installation of two new panels and XFRM transformers,one to
be placed in MCC1 and one to be placed in MCC2.
10. Screwpactor Panel Power—Attachment K
• Discussed in RFI#83
• In RFI#83,the Contractor states that although the contract drawings do not show two
control panels on top of the headworks structure,there is actually one panel for the
barscreen and one panel for the screwpactor as part of the original bid pricing. The
additional screwpactor panel must be installed to complete the working system even
though there is no OCP indicated.
• The Engineer responded by providing instructions to route new conductors plus ground
from the bar screen panel to the screwpador panel,and to connect their two panel circuit
breakers.
• Cost Includes connector of screwpador panel to bar screen panel with conductors plus
ground,and connection of the two panel circuit breakers in parallel.
1L Grinder Starters Removal—Attachment L
• Discussed In RFI#86.
• In RFI#86,the Contractor states the contract drawings show no grinder control panels,but
the approved submittal shows three specific control panels for each of the grinders
requiring 480V power. The MCC gear was approved and delivered with VFD starters for
those grinders;however,the Contractor wants to use their own control panel and starters
for warranty purposes rather than the starters in the MCC gear. To avoid warranty Issues,
the Contractor proposes to remove the VFD sections from the gear,install blank sections,
and provide circuit breakers for 480V power to the grinder control panels.
• The Engineer approved the Contractoes proposed solution.
• Cost includes removal of VFD sections from MCC gear,installation of blank sections,and
purchase and Installation of circuit breakers for 480V power to the grinder control panels
12. Concrete Between Existing Blower Building and Existing Treatment Unit—Attachment M
• In the area of the spread footing foundations for the above ground pipe supports between
the existing blower building and the existing treatment unit,City personnel have said
standing water Is a constant problem. Even with re-grading of the area standing water
could still be a concern and could have potential for degradation of the adjacent building
foundations. To avoid this problem the Engineer recommended placing concrete sidewalk
In this entire area.
• Cost includes placement of concrete between the existing blower building and existing
treatment unit per the sidewalk detail.

LEM would like to know what the intent of design for the blowers was for the operation of the two plants?(i.e.Were the new blowers
going to nm both plants,old and new working together to run both?).As designed on the drawings now there is no way to isolate the
old plant air from the new plant air if one plant should ever need to have air shut down all the valves would need to be closed on that
plant to isolate it.There is a flange at the 24"x 20"reducer just past the 10"air drop to the new CCB where one could be added at this
time which would allow the city to isolate each plant with only one valve to turn.Would the city like to add this valve at this time. I am
trying to release the pipe that runs from the reducer to the existing plant air so time is of the essence for this response.

Ashbrook has been contacted by LEM Construction CO., Inc. (Hunter Howard) and has 1
been asked to provide a cost to make modifications In the field to the new BFP Control
Panel(1307507) and also to the existing Ashbrook BFP Control Panel(904929).
The requested changes to the new BFP Control Panel are:
(1)Add a two position selector switch (PP3 /PP2)to the door and add start I stop and
speed control/indication for a new polymer pump(PP2).
(2)Change out three (3)position selector switch to a two (2) position selector switch for
the control of the sludge feed pumps(SP1 /SP2).
The requested changes to the existing BFP Control panel are:
(1) Add a two (2) position selector switch to the door for start/ stop control of sludge
feed pumps 3&2.
(2) Add a two (2) position selector switch (PP1 /PP2) to the door and add start/ stop
and speed control/indication for the new polymer pump(PP2).
Ashbrook is pleased to provide a proposal to provide the above requested field
modifications.
The cost to make the panel modifications as requested, In the field, will be $16,300.00.
This cost will include drawing revisions for both panels, material, labor, testing, travel
and expenses.

Please identify the control sequence for the level transmitter in the sludge holding tank and what equipment it shall control. There is
no indication that the tank level transmitter signal goes to activate or deactivate the new digested sludge pumps or the existing
digested sludge pumps. LEM belelves that which digester is to be processed from will be at the descrelion of the City of Baytown's
Operators. In so doing,we feel that the level transmitter signal from the sludge holding lank shall govern the operation or the digester
pumps to AUTO based on level set points. Please confirm.
In'addition,LEM does have the provisions for control within the now bell press panel to start and slop the grinders and the MOYNO
sludge teed pumps within the new building. There Is a selector switch on the new panel that will dellniale between 1 or 3 MOYNO

Response:
The City rdquires timers for operation of the WAS and SCUM pumps. The design uses a switch to
select between one or two pump operation. The timer turns the pumps)on and off based on an
series of programmable setpoints. The alternator ensures even wear for all three motors In both
one and two pump operating modes.
install the timers In the existing WAS and SCUM pump local panels. Connect the timer contact to the
existing alternator lead pump terminal. Install the selector switch In Chet moll panel,to the
s. Space for backplate. Connect the selector switch between the lead and lag pump
timer switch Is made available by relocating an existing terminal strip. All connection and removal
details are shown In the attached control diagram markups.
At a minimum,provide 24 hour,15 minute Interval,DIN rail mounted timer switch,Intermatic
model MIL72 series or equal. Timing set points shall be coordinated with plant operators.

We are clear to perform this work. Please have EG proceed with redesigning the panels to eliminate the starters in the
two(2) panels that are onsite. Once the re-design is complete,we will have our electrician perform the work,and have
EG approve the wiring to ensure warranty compliance remains.
LEM authorizes Pump&Power to proceed with this work for an additional$2,400.00($1,200.00/ea)to the original P.O.
I actually may have another Idea for the Effluent Pump panel to run by you and EG if it will be acceptable.

Comments:
1. Effluent lift station control panel-will be relocated from the MCC-3 building to the effluent
lift station. Control and wiring diagrams for relocation are attached.
a. Remove unused starters and related 480V devices and wiring from Digi Gauge control
panel as shown in attached markups.
b. Install control relays to replace motor starters in lift station control panel.
c. Use existing conduit FLT100 to route 60414 control conductors plus ground from Digi
Gauge control panel to MCC-3.
d. Use existing conduit XDR100 to route 2410 power conductors plus ground from Digi
Gauge control panel transformer breaker to MCC-3. Add 15A breaker at MCC-3 to
supply 480V power.
e. Route 1 in.conduit with 2410 conductors from pump junction box at effluent lift
station to relocated Digi-Guage panel.
f. Route 2 in.conduit with 60414 conductors from pump junction box at effluent lift
station to relocated Digi-Guage panel.
g. Route 1 in.conduit with 24414 conductors from pump junction box at effluent lift
station to relocated Digi-Guage panel.
h. Route 1 in.conduit with transducer cable from float transducer junction box at effluent
lift station to relocated Digi-Guage panel.
i. Route 2 in.conduit with 19414 conductors from float transducer junction box at

In partial response to RFI#82,the Enginear stated that there was limited Information to correctly answer the rsst?ing on an additional
panel for the MCC#2 bldg. We feel strarely that an additional panel Is required both here,and also In the MCC#1 Bldg as well. The
A1C Units approved and delivered are low voltage 230v feeds,and the existing XFRM and Penal Is too crowded already to accept the
amperage of the new A/C Units. We propane to add an additional 125 AMP panel and 30 INA single phase Transformer next to the
existing panel and XFRM to accomodate the loads needed to power the A/C units.
Additionally,there are fluid detection systems for the Moyno pumps needed In order to operate the pumps per the menufachuem
guidance. These Instruments mclulre 115v power. Wb propose to add an addillonal 200 AMP penal and 45 KVA XFRM in the MCC
02 room to sceomodate the power to time instruments,the power feeders for the SCUM&WAS Pumps as answered in RFI#82,and
to also lighten the amperage loads we suspect Is already in question In this Wdling.

Install an additional 3 phase,480:208/120,45KVA transformer and a 3 phase,208/120, 125A panel near
the existing panel in the MCC-2 building. This additional transformer should be sized to accommodate all
additional loads required by this RFI. This includes the SCUM and WAS pump control panels,the Moyno
fluid detection systems and the additional security lighting. The MCC-2 building AC circuits may also be
routed to this panel.
MCC-1 room panel will be addressed in Thursday's meeting after existing panel load is measured.
