Ordinance No. 12,120ORDINANCE NO.12,120 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, RENEWING THE CONTRACT OF BASF CORPORATION FOR THE ANNUAL CATIONIC POLYMER SUPPLY CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN,THE SUM OF SIXTY-FIVE THOUSAND TWO HUNDRED NINETY-NINE AND 96/100 DOLLARS ($65,299.96);AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ******************************************************* WHEREAS,CIBA Specialty Chemicals Corporationwas awarded theAnnual Cationic Polymer SupplyContractonNovember25,2008,pursuanttocompetitivebiddingprocedures,whichcontractincluded anoptionbythepartiestorenewforadditionalone-yearperiods;and WHEREAS,such contract was renewed on November 12,2009 and October 25,2010,and can be renewed againforan additional one-year term;and WHEREAS,BASF Corporation,successor ininteresttoCIBA Specialty Chemicals Corporation,has indicateditswillingnesstorenewthecontractforanadditionalyearunderthesametermsandconditionswith no CPI increase;and WHEREAS,theAdministrationhasreviewedthemarketconditionsand recommends renewalasbeing inthe best interest of theCity;NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:ThattheCityCounciloftheCityofBaytownherebyrenewstheAnnualCationic PolymerSupplyContractwithBASFCorporationforthesumofSIXTY-FIVETHOUSANDTWO HUNDRED NINETY-NINE AND 96/100 DOLLARS ($65,299.96)and authorizes payment thereof. Section2:ThatpursuanttotheprovisionsofTexasLocalGovernmentCodeAnnotated §252.048,theCityManagerisherebygranted general authoritytoapproveanychangeorderinvolvinga decrease oran increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00)orless, subjecttothe provision thattheoriginalcontractpricemaynotbeincreasedbymorethantwenty-fivepercent (25%)ordecreasedbymorethan twenty-five percent(25%)withouttheconsent of thecontractortosuch decrease.
