AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,ENLARGING THE BOUNDARIES OF REINVESTMENT ZONE
NUMBER ONE,CITY OF BAYTOWN,TEXAS;CONTAINING FINDINGS
AND PROVISIONS RELATED TO THE FOREGOING SUBJECT;
CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS,theCityCouncil of theCity of Baytown("City")pursuant totheprovisions
of Chapter 311,TexasTax Code,created Reinvestment ZoneNumberOne,City of Baytown,
Texas,(the "Zone");and
WHEREAS,theCitymay enlarge the boundaries of anexistingreinvestmentzone
pursuant toSection 311.007,TexasTax Code;and
WHEREAS,the proposed enlarged zonemeetsthe requirements for enlarging anexisting
reinvestmentzonepursuanttoSection 311.006(b),TexasTaxCode;and
WHEREAS,theproposedimprovementsintheenlargedzonewillsignificantlyenhance
thevalue of alltaxable real propertyinthe proposed enlarged zoneandwillbe of general benefit
totheCity;NOW,THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1.ThattheCityCouncil of theCity of Baytown,Texas,herebyfindsand
declaresthatthefindingsandrecitalscontainedinthepreamble of thisordinancearehereby
foundanddeclaredtobetrueandcorrectandareadoptedaspart of thisordinanceforall
purposes.
Section 2.The City,actingunderandinaccordance with the provisions of Chapter
311,Texas Tax Code,including Sections 311.006 and 311.007(a),hereby enlarges Reinvestment
Zone Number One,City of Baytown,Texas,by addingthe enlargement area described by map
depiction in Exhibit "A,"which isattachedheretoand incorporated herein forall intents and
purposes.
Section 3.The Zone shallbeenlargedas of the effective date of this ordinance.
Section 4.The tax increment baseforthe enlarged Zone shall include thetax
increment base established by theordinancecreatingthe Zone and,beginning January1,2013,
shall include thetax increment baseattributabletothelandaddedtothe Zone by this ordinance,
which shallbeJanuary1,2012.
Section5:If anyprovision,section,exception,subsection,paragraph,sentence,
clauseorphrase of thisordinanceortheapplication of sametoanypersonortheset of
circumstances,shallforanyreasonbeheld unconstitutional,voidor invalid,such invalidity shall
not affect the validity ofthe remaining provisions ofthis ordinance ortheir application toother
persons orsetsof circumstances andtothisendall provisions ofthis ordinance are declared tobe
severable.
Section 6:This ordinance shalltake effect immediately from and after its passage by
theCityCouncil of theCity of Baytown.
