AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
ACCEPTING THE BID OF ANGEL BROTHERS ENTERPRISES,LTD,FOR THE
NORTH MAIN/I-10 UTILITY PROJECT -PHASE 1;AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE AND
ATTEST TO A CONTRACT WITH ANGEL BROTHERS ENTERPRISES,LTD,FOR
SAID CONTRACT;AUTHORIZING PAYMENT NOT TO EXCEED THE SUM OF
SEVEN HUNDRED FIFTY-THREE THOUSAND FOUR HUNDRED SEVENTY-
EIGHT AND NO/100 DOLLARS ($753,478.00);MAKING OTHER PROVISIONS
RELATED THERETO;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS,theCityCounciloftheCity of BaytowndidadvertiseforbidsfortheNorth Main/I-
10UtilityProject-Phase1tobereceivedonNovember6,2012;and
WHEREAS,noticetobiddersastothetimeandplace,whenandwherethebidswouldbe
publicly opened and read aloud was published pursuant to provisions ofTexas Local Government Code
Annotated §252.041;and
WHEREAS,allbidswereopenedandpubliclyreadatCityHall2:00o'clockp.m.,Tuesday,
November6,2012,asperpublishednoticetobidders;NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:ThattheCity Council oftheCityof Baytown herebyacceptsthebidof Angel
Brothers Enterprises,LTD,forthe North Main/I-10 Utility Project -Phase 1 according tothe plans and
specifications set forth by theCity's Engineer,and authorizes payment ofan amount notto exceed
SEVEN HUNDRED FIFTY-THREE THOUSAND FOUR HUNDRED SEVENTY-EIGHT AND
NO/100DOLLARS($753,478.00)basedupontheunitpricesspecifiedinthebid,andtheCityManager
and the City Clerk ofthe City are hereby authorized and directed to execute and attest toa contract with
Angel Brothers Enterprises,LTD,forthe above-described project,said contract containing the plans,
specifications,and requirements of the City's Engineer and appropriate bond requirements in accordance
withtheprovisions of TexasGovernmentCode,Chapter2253.
Section 2:That pursuant tothe provisions ofTexasLocalGovernmentCode Annotated
§252.048.theCity Manager is hereby granted general authority to approve any change order involving a
decrease oran increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00)orless,
subject tothe provision thatthe original contractprice may notbe increased bymorethan twenty-five
percent (25%)or decreased bymorethan twenty-five percent (25%)withouttheconsentofthecontractor
to such decrease.
Section 3:This ordinance shalltakeeffect immediately from anc^after its passage bythe
City Council of theCity of Baytown.
