AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
AUTHORIZING THE PAYMENT IN THE AMOUNT OF ONE HUNDRED
FOURTEEN THOUSAND FIVE HUNDRED THIRTY-FIVE AND 20/100 DOLLARS
($114,535.20)TOTHE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY
FOR THE ANNUAL CONSOLIDATED WATER QUALITY FEES FOR
THE CITY'S FOUR WASTEWATER TREATMENT PLANTS;AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
WHEREAS,the Texas Commission on Environmental Quality ("TCEQ")in response tothe
CleanWaterActhas established aprogramtoassessthequality of theriver basins of theState;and
WHEREAS,SenateBill 818 requirestheTCEQtorecoverthereasonablecostoftheassessment
program fromwastewatertreatmentpermitholdersandwaterrightsholders;and
WHEREAS,the Consolidated Water Quality Feesare assessed annually eachOctober 31s1 and
imposed oneachpersonholdingapermitunderthe V.T.C.A.,WaterCode,§§26.001.el seq.',NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section1:ThattheCityCouncil of theCity of Baytown,Texas,hereby authorizes the
paymentintheamountofONEHUNDRED FOURTEEN THOUSAND FIVE HUNDREDTHIRTY-
FIVEAND 20/100 DOLLARS ($114,535.20)totheTexas Commission on Environmental Quality forthe
Annual Consolidated WaterQualityFeesfortheCity'sfour Wastewater Treatment Plants.
Section2:ThattheCityManagerisherebygrantedgeneralauthoritytoapproveanychange
involvingadecreaseoranincreaseinamountauthorizedinSection1hereinaboveofFIFTY
THOUSAND ANDNO/100 DOLLARS ($50,000.00)orless;however,the original contract pricemay
notbeincreasedbymorethantwenty-fivepercent(25%)ordecreasedbymorethantwenty-fivepercent
(25%)withouttheconsentoftheTexasCommissiononEnvironmentalQualitytosuchdecrease.
Section3:Thisordinanceshalltakeeffect immediately//ram andafteritspassagebythe
CityCouncil of theCity of Baytown.
