Ordinance No. 12,116ORDINANCE NO.12,116 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,PRESCRIBING THE NUMBER OF POSITIONS IN EACH CLASSIFICATION IN THE FIRE DEPARTMENT;PROVIDING A REPEALING CLAUSE;CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************************** WHEREAS,previously,the Chief of theCity of Baytown FireDepartmenthas recommendedtotheCityCouncilthatcertainpositionsinthe Fire Departmentbereclassified and renamed;and thWHEREAS,thelastsuch recommendation wasapproved by the City Council onthe 10 day of September,2009,viaOrdinanceNo.11,184 whereinthenumber of personsineach classification of theFireDepartmentwasestablishedasfollows: Fire Chief 1 Assistant Fire Chief 3 (SubjecttoprovisionsenactedbyOrdinanceNo.8355) Fire Battalion Chief 5 Lieutenant 21 Fire EquipmentOperator 15 Fire Fighter 58;and WHEREAS,theCityCouncilnow desires toamendaclassificationin"ServiceGroup- Fire"to update thenumber of positions in each classification and toincludethe positions created inthe FY2012-13 budget;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1:Thatthenumber of positionsineachclassificationinthe Fire Department shall be as follows: Fire Chief 1 Assistant Fire Chief 3 (Subject to provisions enactedbyOrdinanceNo.8355) Fire Battalion Chief 5 Lieutenant 24 Fire Equipment Operator 18 FireFighter 63 Section2:All ordinancesorparts of ordinances inconsistent with theterms of this ordinanceareherebyrepealed;provided,however,thatsuchrepealshallbe only tothe extent of such inconsistency andinallotherrespectsthisordinanceshallbe cumulative of other ordinancesregulatingand governing the subject matter covered by thisordinance. Section3:Ifanyprovision,section,exception,subsection,paragraph,sentence, clause or phrase ofthis ordinance orthe application ofsametoany person orthesetof circumstances,shallforanyreasonbeheldunconstitutional,voidorinvalid,suchinvalidityshall notaffectthevalidityoftheremainingprovisionsofthisordinanceortheirapplicationtoother persons orsetsof circumstances andtothisendall provisions ofthis ordinance are declared tobe severable. Section 4:This ordinance shalltakeeffect immediately fromand after its passage by theCityCouncil of theCity of Baytown.
