AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,AMENDING ORDINANCE NO.11,587 PRESCRIBING THE
NUMBER OF POSITIONS IN THE CLASSIFICATION "SERVICE GROUP -
POLICE"TO UPDATE THE NUMBER OF POSITIONS IN EACH
CLASSIFICATION AND TO INCLUDE THE POSITIONS CREATED IN THE
FY2012-13 BUDGET;PROVIDING A REPEALING CLAUSE;CONTAINING
A SAVINGS CLAUSE;AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.

WHEREAS,theCityCouncil of theCity of Baytown desirestochangethename of the
classification immediatelybelowthe Chief of Policefrom"Captain"toAssistant Chief without
modifyingthenumber of positions inthe ranks inthe Classification "Service Group -Police";
and
WHEREAS,changing thename of the classification immediatelybelowtheChief of
Police is designed toallow for greater efficiencyinthe department's interactions withother
agencies;and
WHEREAS,Section 143.021(a)of theTexasLocalGovernmentCode requires thatthe
City Council by ordinance prescribe the classifications of all police officers by ordinance;and
WHEREAS,theCity Council last prescribed the classifications of all police officers and
the number of positions in each classification ofthe Police Department on February 24,2011,via
Ordinance No.11,587 as follows:

Assistant Chief.3

WHEREAS,theCityCouncilnow desires toamendaclassificationin"ServiceGroup-
Police"to update thenumber of positionsineach classification andtoincludethepositions
createdinthe FY2012-13 budget;NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1:That Section 1of Ordinance No.11,587,passed the 24th day of February,
2011,relatingtothenumber of positionsintheClassification "Service Group-Police,"ishereby
amended to read as follows:
That the number of positions ineach classification inthe police
department shallbeasfollows:
Chief of Police 1
Assistant Chief 3

Section2:Allordinancesorpartsofordinancesinconsistentwiththetermsofthis
ordinanceareherebyrepealed;provided,however,thatsuchrepealshallbeonlytotheextentof
suchinconsistencyandinallotherrespectsthisordinanceshallbecumulativeofother
ordinancesregulatingandgoverningthesubjectmattercoveredbythisordinance.
Section3:Ifanyprovision,section,exception,subsection,paragraph,sentence,
clause or plirase ofthis ordinance orthe application of same toany person orthesetof
circumstances,shallforanyreasonbeheld unconstitutional,voidorinvalid,suchinvalidityshall
notaffectthevalidity of theremainingprovisionsofthisordinanceortheirapplicationtoother
persons orsetsof circumstances andtothisendall provisions ofthis ordinance are declared tobe
severable.
Section4:This ordinance shalltakeeffect immediately fromand after its passage by
theCityCouncil of theCity of Baytown.
