Ordinance No. 12,002ORDINANCE NO. 12,002 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF TWO HUNDRED THIRTY -FIVE THOUSAND FIVE HUNDRED SIXTY -FIVE AND 58/100 DOLLARS ($235,565.58) TO DOVER INDUSTRIAL PRODUCTS/ROTARY LIFT DIVISION THROUGH THE HOUSTON - GALVESTON AREA COUNCIL FOR THE PURCHASE OF TWO (2) 75,000 LB. AND TWO (2) 18,000 LB. LIFT CAPACITY, FLOOR - MOUNTED LIFTS FOR THE FLEET SERVICES DIVISION OF THE PUBLIC WORKS DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. �+**:** �*. �r►**»> k�>k s**+. s*r** r�** t.*****+. ���..** t.*► a:** * + * *� *s *.r ++r * + +a: * +•�r + * «��+�• WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement which authorizes the Houston - Galveston Area Council to take bids for certain items on behalf of the City of Baytown; and WHEREAS, pursuant to such agreement, the Houston - Galveston Area Council has taken bids for two (2) 75,000 lb. and two (2) 18,000 lb. lift capacity, floor - mounted lifts from Dover Industrial Products/Rotary Lift Division for the Fleet Services Division of the Public Works Department; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of TWO HUNDRED THIRTY -FIVE THOUSAND FIVE HUNDRED SIXTY -FIVE AND 58/100 DOLLARS ($235,565.58) to Dover Industrial Products/Rotary Lift Division, through the Houston - Galveston Area Council for the purchase of two (2) 75,000 lb. and two (2) 18,000 lb, lift capacity, floor- mounted lifts for the Fleet Services Division of the Public Works Department. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25 %) or decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
