Ordinance No. 11,989ORDINANCE NO. 11,989 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING MAXIMUM PRIMA FACIE SPEED LIMITS FOR MOTOR VEHICLES IN DESIGNATED SCHOOL ZONES AND PROVIDING FOR HOURS OF ENFORCEMENT ON SCHOOL DAYS OR WHEN CHILDREN ARE PRESENT; AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS BY THE DIRECTOR OF PUBLIC WORKS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO/ 100 DOLLARS ($200.00); AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. WHEREAS, pursuant to Section 545.356 of the Texas Transportation Code, authorizing alteration of maximum prima facie speed limits with respect to highways or portions thereof within the corporate limits of the City of Baytown based upon engineering and traffic investigations and requested public hearings; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a special hazard exists to traffic safety in the vicinity of elementary schools, junior high schools, senior high schools, and other student attended facilities within the corporate limits of the City of Baytown on days when schools are in session and at times when students and other traffic approach from and depart from the vicinity of such schools and facilities and the City Council hereby makes such findings and determines and declares that the maximum prima facie speed limits to be reasonable, prudent and lawful is either 20, 30 or 35 miles per hour at the time and places designated in Exhibits "A" through "I" attached hereto and incorporated herein for all purposes. Section 2: The Director of Public Works is authorized and directed to place the appropriate signs at the locations described in Exhibits "A" through "I." Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance. SHALL BE 20 MILES PER HOUR UPON THE FOLLOWING STREET LOCATIONS: STREET LIMITS SCHOOL YMCA Drive Between 300 feet west of North Main Street Alamo* and the end of YMCA Drive. South Pruett Street Between 75 feet south of West Republic Street Carver and 75 feet north of Dailey Street. Clayton Drive Between 120 feet north of Ivie Lee Street and Bowie 120 feet south of James Bowie Drive. North Pruett Street Between West Lobit Avenue and Green Street. Lamar North Jones Street Between West Adoue Street and Forrest Lamar Avenue. Virginia Street Between 50 feet west of Georgia street and San Jacinto New Jersey Street. Georgia Street Between 150 feet south of West Main Street San Jacinto and 50 feet south of Kentucky Street. Kentucky Street Between 150 feet east of Louisiana Street and San Jacinto Carolina Street. East James Street Between North 6`h Street and 50 feet west of Ashbel Smith North 4`h Street. Seabird Street Between 50 feet west of Garth Road and 200 Victoria Walker feet west of the school's exit driveway. * The speed restrictions for Alamo Elementary School on YMCA Drive incorporate the Stuart Career Center during the same time periods. EXHIBIT A THE ELEMENTARY SCHOOL SPEED ZONES BETWEEN THE HOURS OF 7:45 A.M. AND 8:45 A.M. AND BETWEEN THE HOURS OF 3:00 P.M. AND 4:00 P.M. SHALL BE 20 MILES PER HOUR UPON THE FOLLOWING STREET LOCATIONS: STREET LIMITS SCHOOL Barkuloo Road Between 650 feet south of the school's south Crockett entrance driveway and 650 feet north of the school's north entrance driveway. Tri -City Beach Road Between 300 feet south of the school's south DeZavala driveway and 550 feet north of the school's north driveway. Massey Tompkins Road Between 300 feet east of the east driveway of Stephen F. Austin Fire Station 3 and 350 feet west of Raccoon Drive. Raccoon Drive Between its intersection with Massey Stephen F. Austin Tompkins Road and 350 feet north of such intersection. EXHIBIT B THE JUNIOR HIGH SCHOOL SPEED ZONES BETWEEN THE HOURS OF 8:15 A.M. AND 9:15 A.M. AND BETWEEN THE HOURS OF 3:30 P.M. AND 4:30 P.M. SHALL BE 20 MILES PER HOUR UPON THE FOLLOWING STREETS: STREET LIMITS SCHOOL Bayway Drive Between 150 feet north of the school's entrance Baytown driveway and Honeysuckle Drive. Elvinta Street Between Center Street and Cedar Bayou Road. Cedar Bayou Kilgore Road Between Cedar Bayou Road and 250 feet south Cedar Bayou of Cedar Bayou Road. West Elvinta Street Between Elvinta Street and 100 feet north of Cedar Bayou Cedar Bayou Road. Cedar Bayou Road Between 50 feet west of West Elvinta Road and Cedar Bayou 250 feet east of the school's bus entrance. EXHIBIT C THE JUNIOR HIGH SCHOOL SPEED ZONES BETWEEN THE HOURS OF 8:15 A.M. AND 9:00 A.M. AND BETWEEN THE HOURS OF 3:45 P.M. AND 4:30 P.M. SHALL BE 30 MILES PER HOUR UPON THE FOLLOWING STREET: STREET LIMITS SCHOOL Archer Road Between 200 feet east of the school's east Gentry entrance driveway and 200 feet west of the school's west entrance driveway. EXHIBIT D THE JUNIOR HIGH SCHOOL SPEED ZONES BETWEEN THE HOURS OF 8:15 A.M. AND 9:15 A.M. AND BETWEEN THE HOURS OF 3:30 P.M. AND 4:30 P.M. SHALL BE 30 MILES PER HOUR UPON THE FOLLOWING STREETS: STREET LIMITS SCHOOL Business Highway 146 Between 275 feet south of the school's faculty Horace Mann entrance and 100 feet south of East Gulf Street. South Alexander Drive Between Business Highway 146 and 200 feet Horace Mann north of Briarwood Street. EXHIBIT E THE HIGH SCHOOL SPEED ZONES BETWEEN THE HOURS OF 7:20 A.M. AND 8:20 A.M. EXHIBIT H THE HIGH SCHOOL SPEED ZONES BETWEEN THE HOURS OF 6:45 A.M. AND 7:45 A.M. AND BETWEEN THE HOURS OF 2:00 P.M. AND 3:00 P.M.
