AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
RENEWING THE AGREEMENT WITH RANDALL B. STRONG FOR THE
COLLECTION OF DELINQUENT TAXES AND PAYMENTS IN LIEU OF TAXES FOR
THE PERIOD BEGINNING OCTOBER 1, 2012, AND ENDING ON SEPTEMBER 30,
2013, AND AUTHORIZING PAYMENT IN THE AMOUNT OF THE ADDITIONAL
PENALTY COLLECTED AS PROVIDED IN SECTION 90 -26 OF THE CODE OF
ORDINANCES, BAYTOWN, TEXAS; MAKING OTHER PROVISIONS RELATED
THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, on July 22, 2010, the City Council authorized an agreement with Randall B. Strong for
the collection of delinquent taxes and payments in lieu of taxes; and
WHEREAS, the agreement may be renewed for three successive one -year terms upon receipt of a
request from the attorney and the approval of the City for continued representation; and
WHEREAS, the City has received a request from the attorney for the continuation of representation
along with a request to revise the benchmarks set forth in the contract so that the same better reflect the
attorney's efforts; and
WHEREAS, the Finance Director agrees with the attorney's proposal to establish a different
benchmark than that which is set forth in the agreement; and
WHEREAS, the attorney and the Finance Director have agreed that the benchmark in the contract
should be revised as follows:
Prior to the adoption of the City of Baytown budget, the City's Finance Director shall,
with input from the Attorney, set an Annual Collection Goal for that budget year which shall
be the amount of delinquent taxes the Attorney shall be expected to collect in that budget
year. This collection goal will be determined by an analysis of the total amount of uncollected
delinquent taxes, the amount of such taxes currently under judgment and /or bankruptcy, the
amount of current year taxes then still uncollected but not yet considered delinquent, and any
other factors determined by the Finance Director as relevant to determining the proposed goal.
The proposed goal shall be the principal amount of tax only; penalty and interest will not be
included in the calculation or in determining the Collection Goal; and
WHEREAS, the Finance Director believes that the continuation of representation with the above -
referenced benchmark is in the best interest of the City; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby renews the agreement with the
new benchmark set forth in the recitals hereinabove with Randall B. Strong for the collection of delinquent
taxes and payments in lieu of taxes for the period beginning October 1, 2012, and ending on September 30,
2013, and authorizes payment in the amount of the additional penalty collected as provided in Section 90 -26 of
the Code of Ordinances, Baytown, Texas.
Section 2: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
