Ordinance No. 11,965ORDINANCE NO. 11,965 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DESIGNATING A PART OF THE AREA LOCATED WITHIN THE CITY OF BAYTOWN'S EXTRATERRITORIAL JURISDICTION BE INCLUDED AS PART OF BAYTOWN INDUSTRIAL DISTRICT NOS. 2 AND 3; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF WHEREAS, Section 42.044 of the Texas Local Government Code expressly provides for the establishment of industrial districts by municipalities within their extraterritorial jurisdictions; and WHEREAS, the City Council through Ordinance No. 893 established Baytown Industrial District No. 2; and WHEREAS, Industrial District No. 2 was amended by Ordinance No. 1806 to remove certain annexed areas from such district; and WHEREAS, the City Council through Ordinance No. 889 established Baytown Industrial District No. 3; and WHEREAS, Industrial District No. 3 was amended by Ordinance No. 1833 to include certain areas in such district and was amended by Ordinance Nos. 1856 and 2295 to remove certain annexed areas from such district; and WHEREAS, the City Council desires to amend the boundaries of Baytown Industrial District Nos. 2 and 3 again in order to include additional property within its extraterritorial jurisdiction in such industrial districts; and WHEREAS, the City Council believes including such additional property within its extraterritorial jurisdiction in industrial districts will be for the mutual advantage to industry and the citizens of Baytown; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby designates the property described in Exhibit "A," which is located within the City of Baytown's extraterritorial jurisdiction and is attached hereto and incorporated herein for all intents and purposes, as a part of Baytown Industrial District No. 2. Section 2: That the City Council of the City of Baytown, Texas, hereby designates the property described in Exhibit "B," which is located within the City of Baytown's extraterritorial jurisdiction and is attached hereto and incorporated herein for all intents and purposes, as a part of Baytown Industrial District No. 3. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. Ordinance Nos. 893, 1770,1795, 1806 and 4286, Thence, North 80 °30'50" East to a point in the eastern bank of Cedar Bayou Stream, said point also being in the City of Baytown eastern extraterritorial jurisdiction line and the City of Mont Belvieu western city limit line, Thence, in a northerly direction following the existing City of Baytown extraterritorial jurisdiction line to a point, said point being the intersection of the south right -of -way line of FM 1942 with the west right -of -way of Hatcherville Road, Thence, in a northerly direction, following the west right -of -way line of Hatcherville Road to a point of intersection with the south right -of -way line of Hatcherville Road, Thence, in a westerly direction, following the south right -of -way line of Hatcherville Road to a point of intersection with the south bank of the Coastal Water Authority Canal, Thence, in a southerly then westerly direction following the south bank of the Coastal Water Authority Canal to a point in line with the east right -of -way of Haddon Road located further south, Thence, in a southerly direction, to a point in the northern most east right -of -way line of Haddon Road, Thence, in a southerly direction, following the east right -of -way of Haddon Road to a point in the most southern east right -of -way of Haddon Road, Thence, in a southerly direction, following the same course as the east right -of -way line of Haddon Road to a point in' the north line of a called 69 acre tract described in general warranty deed recorded under Harris County Clerks File No. G061967, Thence, North 82011 ` 59" East, following the north line of said 69 acre tract to a point for corner of said 69 acre tract, said point also being in the west line of Industrial District No. 2 and being in the east right -of -way of Sjolander Road, Thence, following the westerly and northerly line of Industrial District No. 2 to the Point of Beginning and containing 1935,5193234.133 (4442.59 acres), more or less.
