WHEREAS, Baytown Electric Company was awarded the Annual Electrical Motor Control Centel- Services
Contract on April 24, 2008, pursuant to competitive bidding procedures, which contract included ail option by the
parties to renew For additional one-year periods; and
WHEREAS, SLICII contract was renewed on March 26, 2009, March 11, 2010, February 10, 2011, and can be
renewed again for all additional one-year tern-i; and
WTI EREAS, Baytown Electric Company has indicated its willingness to renew the contract for all additional
year Under the same terms and conditions; and
WHEREAS, the Administration has reviewed the market conditions and recommends renewal as being in the
best interest of the City; NOW THERE]"'ORE
BE IT ORDAINED BY THE CITY COUNCIL OF T1 ]E' CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council ofthe City ofBaytown hereby renews the contract of Baytown Electric
Company for the Annual Electrical Motor Control Center Services Contract for the SUM of ONE HUNDRED
'FI-IOUSAND AND NO/] 00 DOLLARS ($100,000.00), and authorizes payment thereof.
Section 2: That pursuant to the provisions ofTexas Local Government Code Annotated §252.048, tile
City Manager is hereby granted general authority to approve any change order involving a decrease or all increase in
costs of FIFTY TI IOUSAND AND NO/] 00 DOLLARS ($50,000.00) or less, provided that the original contract price
may not be increased by more than twenty -five percent (25,%) or decreased by more than twenty-five percent (25%)
without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately frorn and after itt ssag,e by the City Council of
the City of Baytown.
