OTHER PROVISIONS RELATEDTHERETO; AND PROVIDING FOR THEEFFECTIVE DATE
THEREOF.
WHEREAS, Texas Local Government Code Annotated §252.022 provides that wheri the functional
requirements of'the City call only be satisfied by one SOLH-Ce, thC requirement lor competitive bids is not applicable; and
WI H REAS, the procurement ol'LE'D freeway lighting fixtures (flat (he Texas Department of' Transportation has
approved to be placed on state highways can be satisfied by only one source, RLItid Lighting, Inc., as it is the only
distributor ol'the approved Beta lighting fixtures; NOW 'I"I IFIREFORE
BE IT ORDAINED BY THE CITY COUNCIL Ol"THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council ol'the City ol" BayloNvii,Texas, hereby declares that only one source can
satisl'y file needs of the City for LED freeway lighting I ixtures.
Section 2: That the City Council ot'the City of Baytown, Texas, authorizes payment ol'the sum of'TIXO
HUNDRED SIXTY-SIX THOUSAND SEVEN HUNDRED FORTY-NINE AND NO/I 00 DOLLARS ($266,749,00) to
Rutid Lighting, Inc., as the sole source, I'm the J)Urchase of I-E'D freeway fighting fixtures, being more specifically
described as three hundred seventy-one (371) Beta fighting fixtures, Model 4STR-LWY-2M-I IT-] 2-D-Ul I-SV-700-1 0
YR.
Section 3: That pursuant to the provisions ofTexas Local Government Code Annotated § 252.048, the City
Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of
FIFTY'ri JOUSAND AND NO/I 00 DOLLARS ($50,000.00) or less, subject to the provision that the original contract
price may not be increased by more than twenty -live percent (2511o) or decreased by more than twenty-five percent (25%)
without tile consent of'the contractor to stwh decrease.
