WHERE'AS, Megasand Enterprises, Inc., was awarded the Annual Cement Stabilized Sand Contract on January 11, 2007, pursuant to competitive bidding procedures, which contract included an option by file parties to renew for additional one-year periods; and WFIERIHAS, such contract was renewed oil December 13, 2007, January 8, 2009, I)ecember 10, 2009, and Noven-iber 11, 2010, and can be renewed again for an additional one-year term; and WHEREAS, Megasand Enterprises, file., has inclicated its willingness to renew the contract for an additional year under the same terms and conditions witha 3.4% CPI increase; aand WHEREAS, the Administration has reviewed the market conditions and recommends renewal as being in the best interest of the City; NOW THERE'FORE BE IT ORDAINED BY THE CITY COUNCIL, Of, Tl-If-.' CITY OF BAY'fOWN, TEXAS: Section 1: That the City Council of' the City of Baytown hereby renews the A111111al Cement Stabilized Sand Contract with Megasand Enterprises, Inc., for the sure of ONE HUNDRED SEV I-",' NTY-FOUR "I"HOUSAND SEVEN HUNDRED •OURTE",'EN AND 98/100 DOLLARS ($174,714.98) and authorizes payment thereof'. Section 2: 'fhat pUrStlant to the provisions of Texas Local Government Code Annotated §251048, the City Manager is hereby granted general authority to approve any change order involving as decrease or an increase in costs of FIF-1-Y THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of file CO1lt1'aCtOr to SLICII decrease. Section 3: This ordinance shall take effect immediately from and aftof its passage by the City Council of the City of Baytown.
