AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE SALE OF A PORTION OF THE PROPERTY
ON WHICH THE OLD FIRE STATION NO. 5 IS LOCATED AT 7210
BAYWAY DRIVE TO NAVARRE - ROBBINS PARTNERSHIP FOR FIFTY -
ONE THOUSAND FIVE HUNDRED AND NO /100 DOLLARS ($51,500.00),
CONTINGENT UPON A PLAT ACCEPTABLE TO THE CITY MANAGER
AND APPROVED BY THE BAYTOWN PLANNING AND ZONING
COMMISSION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown advertised to accept offers for the sale of a portion of
the property on which the old Fire Station No. 5 is located at 7210 Bayway Drive to be received
on December 21, 2011; and
WHEREAS, notice to bidders as to the time and place, when and where the offers would
be accepted was published pursuant to the provisions of Chapter 272 of the Texas Local
Government Code; and
WHEREAS, all bids were opened and publicly read in the Municipal Service Center at
2:00 p.m., Wednesday, December 21, 2011, as per published notice to bidders; and
WHEREAS, contingent upon (i) the receipt of payment of FIFTY -ONE THOUSAND
FIVE HUNDRED AND NO /100 DOLLARS ($51,500.00) and (ii) the filing of a plat acceptable
to the City Manager and approved by the Planning and Zoning Commission, the City is willing
to sell a portion of the property on which the old Fire Station No. 5 is located at 7210 Bayway
Drive; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That contingent upon (i) the receipt of payment of FIFTY -ONE
THOUSAND FIVE HUNDRED AND NO /100 DOLLARS ($51,500.00) and (ii) the filing of a
plat acceptable to the City Manager and approved by the Planning and Zoning Commission, the
City Council of the City of Baytown, Texas, hereby authorizes the sale of approximately 17,811
square feet, being a portion of the property on which the old Fire Station No. 5 is located at 7210
Bayway Drive.
Section 2: That upon the satisfaction of the contingencies delineated in Section 1
hereof, the Mayor is hereby granted the general authority to execute a quitclaim deed, conveying
its interest in the property described in Exhibit "A" to Navarre- Robbins Partnership.
Section 3: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.

NO/ 100 DOLLARS ($10.00) and other good and valuable consideration paid by the GRANTEE
herein named, the receipt and sufficiency of which are hereby acknowledged and confessed,
QUITCLAIMS, TRANSFERS, AND ASSIGNS to NAVARRE - ROBBINS PARTNERSHIP, a
Texas general partnership, its successors and assigns, as Transferee, all Transferor's right, title,
and interest in and to the property described in Exhibit "A," which is attached hereto and
incorporated herein for all intents and purposes.
TO HAVE AND TO HOLD all of Transferor's right, title, and interest in and to the
Property, together with all and singular the rights and appurtenances belonging in any way to
Transferor, by Transferee and Transferee's successors and assigns forever. Neither Transferor
nor Transferor's successors or assigns shall have, claim, or demand any right, title, or interest in
all or any part of the Property.
