CC Resolution No. 593 928 RESOLUTION NO. 593 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS , CONFIRMING THE DECLARATION BY THE CIVIL DEFENSE DIRECTOR WITH THE APPROVAL OF THE CITY MANAGER OF THE EXISTENCE OF AN EMERGENCY ON THE 31ST DAY OF AUGUST, 1977. WHEREAS , on August 31 , 1977, the National Weather Bureau forcasted five (5) foot tides which would have flooded the Brownwood Subdivision in Baytown, Texas; and WHEREAS , Section 9-3 of the Code of Ordinances of the City of Baytown provides that the Civil Defense Director may, if the City Council is not in session, with the approval of the City Manager, declare the existence of an emergency subject to confirmation by the City Council at its next meeting; and WHEREAS , after an emergency has been declared pursuant to the provisions of Section 9-3 of the Baytown Code of Ordinances, the Civil Defense Director , subject to the approval of the City Manager, has certain rule making and supervisory powers which are necessary for the protection of health, safety, and property of victims of disasters; and WHEREAS , as a result of the aforementioned threat of flooding , it was necessary for the residents of Brownwood to make a hurried evacuation of their homes; and WHEREAS , as a further result of the aforementioned threat of flooding, and of the evacuation , and attendant security problems, the Civil Defense Director and the City Manager deemed it advisable to declare an emergency without delay; and WHEREAS , City Council is of the opinion that an emergency as contemplated by Section 9-3 of the Code of Ordinances did, in fact exist ; NOW THEREFORE , 929 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS : Section 1 : That the City Council hereby confirms action taken by the Civil Defense Director with the approval of the City Manager in declaring the existence of an emer- gency on the 31st day of August , 1977. Section 2 : Effective Date : This resolution shall take effect from and after its passage by the City Council of the City of Baytown.
