CC Resolution No. 574 856 RESOLUTION NO. 574 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS , ADOPTING THE "CITY OF BAYTOWN PARKS AND RECREATION DEPARTMENT POLICY MANUAL" FOR THE CITY OF BAYTOWN. WHEREAS , many operational procedures of the Parks and Recreation Department of the City of Baytown have been in effect for many years; and WHEREAS , do to the growth of the City and the Parks and Recreation Department , it has become necessary to make changes in addition to such policies and procedures; and WHEREAS , it is deemed advisable to reduce these policies and procedures to writing; and WHEREAS , the Parks and Recreation Advisory Board together with the staff of the Baytown Parks and Recreation Department have compiled a policy manual containing rules and regulations relating to policies and procedures for the Parks and Recreation Department for consideration of Council ; and WHEREAS , the City Council is of the opinion that such policy manual should be adopted; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : That the City Council approves , accepts , and adopts the "City of Baytown Parks and Recreation Department Policy Manual" for the City of Baytown which contains rules and regulations relating to policies and procedures for the Parks and Recreation Department . A copy of said manual is attached hereto marked Exhibit "A, " and made a part hereof for all intents and purposes. ATHLETIC FIELD RESERVATIONS 861 _2_ COMMUNITY BUILDING 862 -3- CITY OF BAYTOWN BAYTOWN COMMUNITY CENTER The Baytown Community Center has been designed to enhance and enrich the cultural interests of the community. The City encourages groups or organizations, which are art, garden, or music in nature to utilize the Center for programs and activities that would benefit the Baytown citizenry. The Center has also been designed to serve community and civic organizations interested in presenting a special event of community-wide interest such as banquets, meetings, pageants, perfor- mances, etc. GENERAL POLICIES 1 . The City shall assume no responsibility for any property placed on or in its facilities or grounds. Further, the Center is released and discharged from any and all liability for loss, injury, or damage to persons or property that may be sustained by the use or occupancy of the facility. 2. Any group using the Center agrees to leave the premises in as good or better condition than that which existed prior to their usage. 3. Any group using the Center agrees to assume all responsibility for any damages or injuries done to the premises as a result of their usage. 4. Alcoholic beverages are not permitted in the building, park, or parking lot. 5. No gambling or loitering shall be permitted on the premises of the Baytown Community Center. 6. No religious services shall be permitted at the Community Center. Religious groups shall be permitted to use the Center's facilities for activities of a non-religious nature. 7. Smoking will be allowed only where ashtrays are provided. 8. No decorative or other materials shall be nailed , tacked, screwed, or otherwise physically attached to any part of the Baytown Community Center without special permission from the Center Supervisor. 9. All groups using the Center shall comply with all laws---federal , state, and local---including all ordinances of the City of Baytown and all rules, regulations, and requirements of the Police and Fire Departments. 863 -4- 10. Any groups requiring additional services which are not normally provided by the Center---such as special sound and lighting equip- ment, additional stage facilities , extra electrical and utility services, etc.---must be furnished solely by the individual group who agrees to assume all necessary expenses. 11 . Any group using the Center shall agree to abide by and conform with all rules and regulations, which may be adopted from time to time at the Baytown Community Center. Included would be any and all alterations that might be imposed on ,the operational hours and utilization policies of the Center. 12. Only Center personnel or authorized representatives shall be permitted to operate any equipment at the Baytown Community Center, including all stage facilities. 13. Applicants shall not discriminate against any persons on the grounds of race, color, national origin, religion, or sex while using the Baytown Community Center. 14. Groups having reservations at the Baytown Community Center shall be permitted to use only the area(s) which were designated to them at the time the reservations was confirmed. 15. Displays, posters, and advertisements must be approved and posted by the Center Supervisor. 16. No group shall schedule an event which will have a larger attendance than the seating capacity of their reserved area. 17. All Community Center equipment (tables, chairs, etc.) shall remain in the Building at all times. 18. No oral agreements for use of any facility at the Community Center shall be valid. All reservations must be confirmed with a written contract, signed and approved by the Center Supervisor and the reserving party. 19. Anyone entering the center improperly attired shall be asked to leave by the Center Supervisor. 20. The Director of Parks and Recreation reserves the right to refuse any group the privilege of using the Community Center for six (6) months due to abusing the policies of the building.. Any group charged with a - second occurence of abuse will be barred from making any further reservation. In addition, any first occurence deemed flagrant by the Parks and Recreation Advisory Board may be barred permanently from making furhter reservations. 864 -5- PROCEDURAL POLICIES I . OPERATIONAL HOURS: 1. The operational hours of the Baytown Community Center shall be 9:00 a.m. to 10:00 p.m. Monday through Thursday, 9:00 a.m. to 11 :00 p.m. Friday and Saturday and Sunday from 9:00 a.m. to 5:00 p.m. 2. The office hours of the Baytown Community Center shall be from 8:00 a.m. to 12:00 noon and 1 :00 - 5:00 p.m. Monday through Friday. II . RESERVATION POLICIES: 1 . Reservations and all business transactions shall be conducted with the Center Supervisor during established office hours. (8:00 a.m. - 12:00 noon and 1 :00 - 5:00 p.m. Monday through Friday) . 2. Reservations may be made to the Center Supervisor by phone or in person, but confirmation of the reservation must be made in person not later than five (5) working days after the request for a reservation was made. All fees must be paid at time of confirmation. Any reservation not confirmed within the week's period shall be considered cancelled. 3. Special permission for out of town reservations can only be made with the consent of the Director of Parks and Recreation. 4. Whenever a group or an organization requests a reservation for an activity that is questionable or that is not encompassed within the established policies of the center, the Supervisor reserves the right to request the group to obtain special permission from the Director of Parks and Recreation. 5. All person(s) signing the contract and confirming the reservation shall be present at the time of the scheduled activity. This person shall be liable for any and all damages that should occur and shall be responsible to the Center in the event that a problem should arise. 6. Programmed activities conducted by the Parks and Recreation Department will have priority over all other reservations. III . OCCUPANCY PERIODS: Reservations shall be scheduled for specific occupancy periods in the morning, afternoon, and evening. These occupancy periods will be considered from 9:00 a.m. to 12:00 noon, 1 :00 p.m. to 5:00 p.m. , and 6:00 p.m. to 10:00 p.m. , (11 :00 p.m. Friday b Saturday) , respectively. Any extension of these occupancy periods must be approved by the Center Supervisor. A fee of $10.00 per hour shall be imposed on a reserving party if they extend past their occupancy period in the morning, afternoon, or evening. Any part of an hour shall constitute a whole hour. Under no condition shall the Center remain open after midnight. 86S IV. FREQUENCY OF RESERVATIONS: 1 . Reservations will be accepted and confirmed on a first-come, first-serve basis. 2. No single activity of special-interest group shall be permitted to monopolize the Center. The frequency a group may utilize the building will be determined by the Center Supervisor in order for the building to best serve the interests of all groups. 3. The Community Center Auditorium is designed for special events of community-wide interests, and may not be reserved more than four times per month, twice during the week (Monday-Thursday) , and twice on the weekend (Friday-Sunday) by any group or individual . Groups or individuals who have reserved the Auditorium the limited times per month may request additional use if it is available five (5) days prior to the desired date. if the auditorium is available, there will be not additional charge. V. ANNUAL RESERVATIONS: 1 . Reservations shall be accepted no more than a year in advance. Annual reservations will be accepted with the calendar year considered from June 1st to May 31st. Groups wishing to renew annual reservations will be scheduled on a first-come, first-serve basis beginning May 1st. 2. Civic Clubs and Organizations will be limited to one free meeting per month. The rooms available for free meetings include the Activity Rooms and the Meeting Room. The Tejas Room may be scheduled for use when in the opinion of the Center Supervisor it will not interefere with Teen Activities. 3. All Annual Reservations are limited to two per week. VI . WEDDINGS: Rooms reserved for weddings cannot be reserved by session. The room must be reserved all day to allow for deliveries, decorations, etc . Weddings will be calssified as Private. VII . RELIGIOUS MEETING DEFINITIONS: A religious meeting shall be defined as any meeting assembled for a religious purpose such as prayer, worship, Bible study, or theological and doctrinal discussion or debate. The aim of such meeting would be to further the ends of the religious group or organization holding the meeting. 866 -7- Vlll . SERVICES FURNISHED BY CENTER: 1 . During the scheduled event (s) , a Center representative shall be available in the office to oversee all activities of the building. He will have custody of any key that a group(s) might need. All keys to the building premises shall at all times be in control of the Supervisor. The Center representative shall not be permitted to perform any personal services in conjunction with a scheduled activity. Each group shall be expected to provide and assume all expenses for such services as stage employees, light and sound technicians, and break-dotrn of any special equipment and furnishings, (exclusive of the chairs and tables owned by the Center) . 2. There will be a $5.00 deposit required on the dressing room key to be returned upon the return of the key. IX. OUTSIDE CONTRACT SERVICES: Any group needing to contract outside services during their usage of the Community Center facilities must first obtain consent and approval for such designated services. Only experienced and well qualified technicians, who have been specifically approved by the Center Supervisor, shall be permitted to operate the stage equipment. The Center Supervisor has the right to determine whether or not an individual is qualified to operate the stage equipment. X. POLICE PROTECTION: The Center Supervisor shall reserve the right to determine whether police security shall be required during a scheduled activity. Furthermore, the Center Supervisor in collaboration with the City's Police Department shall determine the amount of security that shall be required during the occupancy of the Baytown Community Center. The Center Supervisor shall make any and all necessary arrangements for police security, with the understanding that the reserving party shall be responsible for all such expenses. If a reserving party refuses to assume the cost for such police security, then the reservation shall be subject to cancellation. XI . RESERVATION FEES: 1 . Any reservation for which a fee is involved, the fee(s) must be paid at the time the reservation is confirmed. Additional charges shall be assessed for property damages, and extended occupancy periods. The reserving group shall pay all additional charges to the Center Supervisor during office hours on the day immediately following the scheduled activity. All money transactions shall be handled directly with the Center Supervisor. 2. All money collected for reservations at the Baytown Community Center will be deposited into the City of Baytown's General Fund. A receipt will be issued by the Center Supervisor. 3• There will be no charges for activities co-sponsored by the Parks and Recreation Department. 867 X U . AMOUNT OF RENTAL: 1 . The Center shall establish rental rates for any or all parts of the Baytown Community Center facility according to the classification of the reserving party. The classification of any group shall be determined by the Center Supervisor. All fee schedules shall be reviewed and adjusted from time to time by the Center Supervisor, Director of Parks and Recreation, and the Parks and Recreation Advisory Board. (See attached Schedule of Rental Fees) 2. All reserving groups desiring to be 'classified as a non-profit, tax-exempt, charitable organization shall present proof to the Center Supervisor verifying their charitable status., 3. Groups requesting additional rooms (babysitting, etc.) will be charged according to their classification. X1.11 . CONFIRMING RESERVATIONS: No reservation shall be confirmed by the Center Supervisor until the requesting group has provided all necessary information in order to determine the specific arrangements, facilities, and services required by the event. The Center Supervisor shall require all requesting groups to sign a contract and to pay all necessary fees before any reservation is confirmed. XIV. SUBLEASING PROHIBITED: At no time shall a reserving party sublease or assign its reservation to another group or organization. Only individuals who have specific permission from the Center Supervisor and possess a confirmed, written reservation shall utilize facilities at the Center. No reserving group shall change or rotate its designated hours with another reserving party without first receiving special permission from the Center Supervisor. Organizations who violate this policy shall lose their privilege of using the Community Center and all future confirmed reservations shall be considered cancelled. XV'. CANCELLATIONS AND REFUNDS: 1 . The Center must be notified promptly by the reserving party whenever a scheduled event must be cancelled. If a group does not notify the Center Supervisor, then the Center reserves the right to cancel all future confirmed reservations held by that group. All fees shall be forfeited when a group fails to notify the Center of a cancellation. 2. No refunds will be given for a cancellation by the reserving party. - Credit for rental fees will be given in lieu of refunds if the cancellation is made two weeks prior to the reservation. 2. When scheduled events must be cancelled by the Parks .and Recreation Department, refunds will be given. 868 -9- XVI . USAGE OF THE KITCHEN: 1 . The Kitchen shall never be assumed to be included in a reservation for a Meeting Room or for the Auditorium. A separate reservation shall be made for this area, with specific times allocated to the reserving party. The Center shall require all groups to leave the facilities in as good or better condition than which existed prior to their usage. Each user shall reimburse the Center for any loss or damage to the facilities. 2. Fee for kitchen usage is $12.50. XVIL. DISTRIBUTION OF PUBLICITY MATERIALS: No reserving party or other persons shall erect or display in any manner any advertising signs or structure in the Center without express permission of the Supervisor. CLASSIFICATION OF RESERVING PARTIES All reserving parties must be classified by the Community Center according to the following classes of functions before any reservation is confirmed. CLASS I - Scholastic This class shall apply to all school-oriented organizations who desire to sponsor banquets, guest speakers, meetings, etc. CLASS 11 - Mon-Commercial , Non Fund Raising This class shall apply to all local persons and civic organizations possessing a non-profit association state charter and who sponsors an activity, event, or meeting of community interest. Their proposed event shall be free and open to the public, with no monies derived whatsoever from the event. CLASS IIA - Non-Commercial , Non-Fund Raising - Annual Reservations This class shall apply to all local persons and civic organizations possessing a non-profit association state charter and who sponsors an activity, event, or meeting of community interest. Their proposed event shall be free and open to the public, with no monies derived whatsoever from the event. These reservations are made annually in June. CLASS III - PRIVATE This class shall apply to private use of the facilities of the Community Center, such as wedding receptions, private parties, or private dances. 869 -10- CLASS IV - Professional This class shall apply to any group holding meetings or activities to further the pursuit of a profession. This shall apply to such activities as meetings, seminars , conferences , and conventions. CLASS V - Non-Local Resident This class shall apply to the people who are not citizens of Baytown. CLASS VI - Non-Commercial , Fund-Raising This class shall apply to all local persons and civic organizations possessing a non-profit association state charter and who sponsors an event in which monies are derived--whether through admissions , donations , concessions , sales, or in any other manner. Regardless of whether or not any profits or net receipts are derived from the scheduled activity, it shall be classified in Class VI . CLASS VII - Commercial This class shall apply to all events and activities sponsored or contracted by profit making or commercial organizations or individuals. All groups of commercial nature shall be considered in this class, regardless of whether or not their sponsored event is a profit-making one. Applicant will assume responsibility for the damages to the equipment; furniture, or building. 2. Applicant will not discriminate against any person on the grounds of race, color national origin, religion, or sex under any program or activity using, or during the use of these facilities. 3. Decorations may be applied to walls with masking tape (no tacks, staples, or nails) . Any decorations must be cleared through the Community Center Supervisor. 4. No alcoholic beverages will be permitted in the building or surrounding area. 5. No reservation will begin before 9:00 a.m. in the morning or continue later than 10:00 p.m. without special permission of the Community Center Supervisor. 6. Smoking is permitted in the Activity and Meeting Rooms but not in the Auditorium, unless tables and ash trays are provided. 7. Any group failing to use their reservation without giving proper notice will be barred from making any further reservations for a period of time to be determined by the Director of Parks & Recreation and the Parks & Recreation Advisory Board. 8. There will be no refunds unless the reservation is cancelled by the Parks & Recreation Department. Rental fees may be used for another date. 9. It is the responsibility of the individual signing this reservation to leave reserved rooms in good order. All crumbs, spills, etc. , must be cleaned before leaving the building. Garbage must be bagged in commercial plastic bags. 10. An adult must sign for a reservation. NOTICE: Any person judged to be abusing reservation privileges may be barred from making further reservations! ! ! NAME OF ORGANIZATION SIGNATURE OF PERSON APPLYING ADDRESS TELEPHONE 873 -14- TEEN CENTER Suggested Hours of Operation Operating Hours Monday through Saturday 5:00 p.m. until 9:00 p.m. Sunday 1 :00 p.m. until 5:00 p.m. Persons signing for the Teen Center must be a parent, guardian or adult chaperone. There must be at least four (4) chaperones at each dance or party. Reservations must be made two (2) weeks in advance. There will be no rental fee for teen functions. Hours for teen parties are from 7:00 p.m. until 12:00 midnight. Hours of operation for the Teen Center will be determined by the Director of Parks and Recreation. Teen Center Regulations A. Definition of students: 1 . Junior School - Grades 6, 7, h 8 Senior High - Grades 9, 10, 11 , S 12 College or equivalent . Eligible students are junior school , high school , and college age. All decorations must be taken down before leaving the building. String and masking tape are the only acceptable means of decorating. All loose spills, paper, and trash must be cleaned before leaving the building. All decorating will be done no earlier than two (2) hours prior to the party. Decorations will be attached with string from ceiling and masking tape from the walls. Decorations will be discussed with, and approved by the Community Center Supervisor. This person shall be liable for any and all damages that should occur and shall be responsible in the event that a problem should arise. 6. Programmed activities conducted by the Parks and Recreation Department will have priority over all other reservations. II . OCCUPANCY PERIODS: Reservations shall be scheduled for specific occupancy periods in the morning, afternoon, and evening. These occupancy periods will be considered from 9:00 a.m. to 12 :00 noon, 1 :00 p.m. to 5:00 p.m. , and 6:00 p.m. - 10:00 p.m. A fee of $10.00 per hour shall be imposed on a reserving party if they extend past their occupancy period in the morning, afternoon , or evening. Any part of an hour shall constitute a whole hour. Under no condition shall the activity continue after midnight. 877 -t8- lll . OUTSIDE CONTRACT SERVICES: Any group needing to contract outside services during their usage of the facilities must first obtain consent and approval for such designated services_ Only experienced and well qualified technicians, who have been specifically approved by the Superintendent of Recreation, shall be permitted to operate the stage equipment. The Superintendent of Recreation has the right to determine whether or not an individual is qualified to operate the stage equipment. IV. POLICE PROTECTION: The Superintendent of Recreation shall reserve the right to determine whether police security shall be required during a scheduled activity. Furthermore, the Superintendent of Recreation in collaboration with the City' s Police Department shall determine the amount of security that shall be required during the occupancy. The Superintendent of Recreation shall make any and all necessary arrangements for police security, with the understanding that the reserving party shall be responsible for all such expenses. If a reserving party refuses to assume the cost for such police security, then the reservation shall be subject to cancellation. V. RESERVATION FEES: 1 . Any reservation for which a fee is involved, the fee(s) must be paid at the time the reservation is confirmed. Additional charges shall be assessed for property damages , and extended occupancy periods. The reserving group shall pay all additional charges during office hours on the day immediately following the scheduled activity. 2. All money collected for reservations will be deposited into the City of Baytown's General Fund. A receipt will be issued. 3. A $50.00 deposit is required. This deposit will be returned upon the following conditions: a. If cancellation is needed, it must be done 10 days prior to the scheduled event. b. The area is left clean and all garbage picked up and bagged. c. All facilities are left in good condition. d. The keys are returned the first working day- after use. 4. There will be no charges for activities co-sponsored by the Parks and Recreation Department. V1 . AMOUNT OF RENTAL: 1 . The Parks and Recreation Department shall establish rates according to the classification of the reserving party. The classification of any group shall be determined by the Superintendent of Recreation. All fee scheduled shall be reviewed and adjusted from time to time by the Director of Parks and Recreation , and the Parks and Recreation Advisory Board. (See attached Schedule of Rental Fees) 2. All reserving groups desiring to be classified as a non-profit , tax-exempt , charitable organization shall present proof verifying their charitable status. -19- 878 VII . CONFIRMING RESERVATIONS: No reservations shall be confirmed until the requesting group has provided all necessary information in order to determine the specific arrangements, facilities, and services required by the event. The Superintendent of Recreation shall require all requesting groups to sign a contract and to pay all necessary fees before any reservation is confirmed. Vill . SUBLEASING: Subleasing fund raising booths is permissible with approval of the Parks and Recreation Director. There will be a fee of $5.00 per booth in addition to the facility rental fee. IX. CANCELLATIONS AND REFUNDS: 1. The Superintendent of Recreation must be notified promptly by the reserving party whenever a scheduled event must be cancelled. All fees shall be forfeited when a group fails to notify the Superintendent of a cancellation. 2. No refunds will be given for a cancellation by the reserving party. Credit for rental fees will be given in lieu of refunds if the cancellation is made two weeks prior to the reservation. 3. When scheduled events must be cancelled by the Parks and Recreation Department , refunds will be given. X. DISTRIBUTION OF PUBLICITY MATERIALS : No reserving party or other persons shall erect or display in any manner, any advertising signs or structure without permission of the Superintendent of Recreation. CLASSIFICATION OF RESERVING PARTY CLASS 1 - Scholastic This class shall apply to all school-oriented organizations. CLASS 11 - Non-Commercial , Non-Fund Raising This class shall apply to all local persons and civic organizations possessing a non-profit association state charter and who sponsors an activity, event, or meeting of community interest. Their proposed event shall be free and open to the public, with no monies derived whatsoever from the event. CLASS III - Private This class shall apply to private use of the facility, where the public is not invited. 879 -20- CLASS IV - Professional This class shall apply to any group holding activities to further the pursuit of a profession. CLASS V - Non-Local Resident This class shall apply to the people who are not citizens of Baytown. No cut-offs, chewing gum, combs, shoes, undershirts, or bobbie-pins are allowed in the swimming pools. Particles of these items stop up the filteration system which results in costly repairs and closure of the pool during repairs. Also floats, masks, water wings, and air mattresses are not allowed. These items are considered hazardous to those who cannot swim (for example, they could drift into deep water, and the materials off of these items could stop up the filteration system) . 2. No pushing, throwing of items, or horsing around in the pool area is allowed. Actions of this type could cause injury to you or others in the pool area. 3. Only one (1) person at a time is allowed on the diving board. More than one can cause damage to the board or can result in an accident. 4. Bounce only one (1) time on the diving boards. More than one bounce can cause stress and strain on the diving board and possible loss of balance to cause someone to slip and fall . 5. All swimmers must go through showers and step in the foot bath disinfectant tub before entering pool . The purpose of this procedure is to wash foreign particles off the body and to kill as many germs as possible before entering the pool . 886 -27- 6. Please do not play with pool equipment. _The equipment is for emergency use only. 7. Do not talk with the lifeguards. Lifeguards attention should be on the pool in case of an emergency. 8. Do not swim under diving boards. A diver could possibly collide with someone under the diving boards causing injury to both swimmers. 9. No glass items in the pool area are allowed. 10.
