CC Resolution No. 565 840 RESOLUTION NO. 565 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ADOPTING A FACILITY PLAN AND AN ENVIRONMENTAL ASSESSMENT FOR A WEST SEWER DISTRICT PLANT FOR THE CITY OF BAYTOWN. WHEREAS, it is necessary for the City of Baytown to add sewer plant capacity to its West District in order to adequately serve the waste disposal needs of its citizens; and WHEREAS, the City applied to the Texas Water quality Board and the Environmental Protection Agency for a federal grant pursuant to the Water Pollution Control Act to build additional sewer works ; and WHEREAS , the City has initiated study of and established a timetable for construction of sewer works in the West Sewer District pursuant to EPA Grant No. C-48-1151-01-1 (formerly No. WPC-Tex-1151) ; and WHEREAS, Langford Engineering, Inc . has gathered data and presented the City with various alternatives to meet the City' s waste disposal needs; and WHEREAS, at a public hearing on the proposed construction of sewage treatment facilities and rehabilitation of sewers in the West Sewer District held on January 27 , 1977 , the city received significant public response favoring adoption of that facility alternative that involved construction of new sewer works at the Interstate Highway 10/Spring Gully site with transportation of the effluent to the San Jacinto River for discharge ; and WHEREAS , the engineering studies , data, alternatives , and public input presented to the City have been compiled into two documents, entitled "Facility Plan" and "Environ- mental Assessment" ; and 841 WHEREAS , on the basis of the engineering studies and the public input at the hearing on the proposed sewage works, the best practicable waste treatment technology over the expected life of the works , consistent with the objectives of the Water Pollution Control Act , requires construction of a new treatment plant described in Appendix B of the "Facility Plan" , with transportation of the effluent to the San Jacinto River for discharge; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : That the City Council accepts and adopts both the "Facility Plan" and the "Environmental Assessment" , and certifies as true all the facts and data presented therein. Section 2 : That the City Council proposes that the construction of a new sewage treatment plant at the Inter- state Highway 10/Spring Gully site with transportation of the effluent to the San Jacinto River for discharge is most cost effective and in the best public interest of the citizens of Baytown . Section 3 : That the City Council assures the Texas Water Quality Board and the Environmental Protection Agency that it will use and comply with the "Facility Plan" and "Environmental Assessment" . Section 4 : That this resolution shall become effective immediately from and after its passage by the City Council .
