RESOLUTION NO. 561
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS , SETTING ASIDE A PORTION OF BAYLAND PARK TO BE
USED AS NATURAL ESTUARINE HABITAT.
WHEREAS , the City of Baytown must elevate and reconstruct
the Market Street Bridge spanning the Goose Creek Stream to
provide an essential escape route during hurricanes , tropical
storms, and other natural disasters; and
WHEREAS , the U. S . Department of the Interior Fish and
Wildlife Service and the Texas Parks and Wildlife Service
and the Texas Parks and Wildlife Department have filed
objections to the fill of shallow water estuarine habitat
required by the conventional embankment system method of
bridge construction proposed by the City; and
WHEREAS , the U. S . Department of the Interior Fish and
Wildlife Service and the Texas Parks and Wildlife Department
have indicated that they will withdraw their objections to
the proposed method of bridge construction if the City would
set aside a portion of the Bayland Park to be left in a
natural state to provide feeding, resting, and nursery
habitat for fish, crustaceans , and wildlife; NOW THEREFORE ,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1 : That the City Council of the City of Baytown
intends to set aside approximately 4 .435 acres of the Bayland
Park, shown more particularly in Exhibit "A" attached, and
plans to leave that portion of Bayland Park in a natural
state.
Section 2 : This resolution shall take effect immediately
from and after its passage by the City Council of the City
of Baytown, Texas.
